Resolution - 8820 RESOLUTION OF INTENTION NO.882 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF If -EST COVINA, CALIFORNIA, DECLARING -ITS . INTRMON TO VACATE THAT CERTAIN PUBLIC STREET IN SAID CITY KNOWN AS A PORTION OF VALINDA. AVENUE, IN SAID CITY, AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO.THE.PROPOSED.VA CATION.. THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES RESOLVE, ORDER AND DETERMINE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and the City Council of the City of West Covina does hereby declare its intention to vacate all of that portion of that certain public street in said City known as Valinda Avenue, being that portion of said Valinda Avenue described as follows, to wit: Beginning at a point in the Easterly line of Valinda. Avenue, 60 feet wide, (formerly known as Covina Avenue) as shown on map.of E.J.Baldwin's Fifth Subdivision of a. portion of Rancho La Puente, as recorded in Book 12, Pages 134 and 135.of Maps, on file in the office of the County Recorder of said County, said point being the point of intersection of a line parallel with the Southeasterly line of Glendora Avenue, and distant 10.00 feet Southeasterly therefrom, measured at right angles, with the Easterly line of said Va.linda Avenue; thence Southerly along said Easterly -line 60 feet, more or less, to a point of intersection with the Northeasterly line of the Los Angeles County Flood Control District's Right of Way, 150 feet wide; thence Northwesterly along said Northeasterly Right of Way line, 45 feet, more or less, to a point of intersection with the above mentioned parallel line; thence Northeasterly along said parallel line 60 feet, more or less, to the point of beginning This Council further determines that the public convenience and necessity require the reservation and. exception to the City of West Covina of the right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, storm drains and appurtenant structures in, upon, over and across said properties, and to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, Ms wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water and incidental purposes, including access and the right to keep the properties free from inflammable materials, and good growth, and otherwise protect the same from all hazards in, upon and over the streets and portions of street proposed to be vacated as declared herein; and that the proceedings taken hereunder are subject to such reservations and exceptions. SECTION 2. A map or plan indicating by boundary lines the extent of the property included in the proposed vacation is on file in the office of the City Clerk and reference is hereby made to said map or plan for a further, full and complete descrip- tion of all the property comprising the aforesaid portion of the public street proposed to be vacated as declared herein. SECTION 3. Any and all persons interested in or objecting to the proposed vacation may appear before this Council on the S27th day of February, 1956, at 8:00 o'clock P.M., of said. day, in the Council Chamber of said City Council in the City Hall, in the City of West Covina, and show cause why said. portion of such public street should not be vacated and abandoned as aforesaid. SECTION 4. The Superintendent of Streets shall cause to be posted notices of the passage of this Resolution at the places, and in the manner required by law. These proceedings are taken under and by virtue of the provisions of the Street Vacation Act of 1941, as amended, being Sections 8300 to 8331 inclusive of the -2- Streets and Highways Code of the State of California. SECTION 5. The City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and hereby designated for that purpose. I HEREBY CERTIFY that the foregoing Resolution of Intention was adopted at an adjourned regular meeting of the City Council of the City of 'West Covina, held on the 6th day of Februarym 1956, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen jAMEs yv.
