AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, AMENDING SECTION 2-151 (POWERS AND
DUTIES) OF DIVISION 2 (CITY MANAGER) OF ARTICLE IV
(OFFICERS) OF CHAPTER 2 (ADMINISTRATION) OF THE WEST
COVINA MUNICIPAL CODE RELATED TO CITY MANAGER
SIGNATURE AUTHORITY
WHEREAS, California Government Code § 40602 generally requires the Mayor to execute
all contracts on behalf of the City unless the City Council by ordinance, gives signature authority to
a city officer; and
WHEREAS, the City Council believes that it is in the best interest of the City to have
contracts executed expeditiously after being approved by the City Council; and
WHEREAS, it is appropriate to authorize the City Manager to execute contracts on
behalf of the City when directed by the City Council, or as provided for by ordinance.
NOW THEREFORE, the City Council of the City of West Covina does ordain as
follows:
SECTION NO. 1: The above recitals are true and correct and are incorporated herein as if
set forth herein in full.
SECTION NO. 2: Section 2-151 (Powers and duties) of Division 2 (City Manager) of
Article IV (Officers) of Chapter 2 (Administration) of the West Covina Municipal Code is hereby
amended to add the following subsection (r):
(r) Authorization to sign documents. It shall be the duty of and the City Manager is
hereby authorized to execute documents as provided in California Government Code
Section 40602, whenever such documents are within the City Manager's purchasing
authority or have been approved by the City Council for execution by the City
Manager by resolution, motion, minute order or other appropriate action.
SECTION NO. 3: The City Council hereby finds that it can be seen with certainty
that there is no possibility the adoption and implementation of this Ordinance may have a
significant effect on the environment. The Ordinance is therefore exempt from the
environmental review requirements of the California Environmental Quality Act pursuant
to Section 15061(b) (3) of Title 14 of the California Code of Regulations.
SECTION NO. 4: Severability. If any section, subsection, subdivision, paragraph,
sentence, clause or phrase of this Chapter, or its application to any person or circumstance,
is for any reason held to be invalid or unenforceable, such invalidity or unenforceability
shall not affect the validity or enforceability of the remaining sections, subsections,
subdivisions, paragraphs, sentences, clauses or phrases of this Chapter, or its application to
any other person or circumstance. The City Council declares that it would have adopted
each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof,
irrespective of the fact that any one or more other sections, subsections, subdivisions,
paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable.
SECTION NO. 5: This ordinance shall take effect thirty (30) days after its final passage
and within fifteen (15) days after its passage, the City Clerk of the City of West Covina shall
certify to the passage and adoption of this ordinance and to its approval by the Mayor and City
Council and shall cause the same to be published in a newspaper in the manner required by law.
