Ordinance - 2249ORDINANCE NO. 2249 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADDING ARTICLE X - SECTION 2-500 REQUIRING THE VOTE OF A MAJORITY OF WEST COVINA VOTERS IN ORDER TO APPROVE ANY TRANSACTION INVOLVING THE SALE, LEASE OR RENT TO A PRIVATE PARTY OF PROPERTY LOCATED IN THE CIVIC CENTER OF WEST COVINA, WHICH IS BORDERED BY WEST COVINA PARKWAY, SUNSET AVENUE, AND GARVEY AVENUE THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIAIij DOES ORDAIN AS FOLLOWS: SECTION 1. Article X, Section 2-500 is hereby added to the West Covina Municipal Code to read as follows: Ir ARTICLE X. RESTRICTION ON THE SALE, LEASE OR RENT OF CIVIC CENTER PROPERTY TO PRIVATE PARTY. Sec. 2-500. Voter Approval Required for the Sale, Lease or Rent of Civic Center pp q Property Prior to Entering into a Transaction with a Private Party. (a) To sell, lease or rent any portion of property to a private party in the Civic Center of West Covina, which is the property bordered by West Covina Parkway, Sunset Avenue, and Garvey Avenue, a majority of West Covina voters must approve the transaction at a regular election. (b) The requirement necessitating voter approval prior to leasing or renting any portion of Civic Center property to a private party, as set forth in subsection (a) above, does not include the lease or rental of office space within Cityl Hall or other buildings owned by the City of West Covina and does not include the short term lease or rent of land and/or facilities located at the Civic Center property. The requirement necessitating voter approval prior to leasing or renting any portion of Civic Center property to a private party, as set forth in subsection (a) above, also does not include the rent or leasing of land or the attachment of equipment to public buildings or structures to utility companies or to companies that provide communication or telephonic services. (c) In order to change the language of or repeal this Section, a majority vote of the electorate of the City of West Covina must approve such change or repeal at a regular municipal election of the City. SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law and this ordinance shall take effect on the 31 Sc day following its final passage and adoption.
