AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, AUTHORIZING THE CITY COUNCIL TO
ESTABLISH NEIGHBORHOOD PARKING PROTECTION ZONES FOR
THE ENHANCEMENT OF PARKING PENALTIES IN DESIGNATED
• STREETS AND PORTIONS THEREOF
WHEREAS, West Covina Municipal Code § 22-174 makes it unlawful for any person to
park or stand any vehicle on certain streets or portions thereof after appropriate signage has been
posted indicating said prohibition or restriction; and
WHEREAS, pursuant to Vehicle Code §40203.5, a local agency's schedule of penalties
for parking violation shall be established by the governing body of the local agency, and to the
extent possible, penalties must be standardized with those of other issuing agencies in the same
county; and
WHEREAS, on May 6, 2003, by Resolution No. 2003-45, the penalty imposed for
violation of Section 22-174 of the West Covina Municipal Code was increased, along with other
fines and penalties, after a review of the results of a survey of the same and/or similar fines
penalties imposes by surrounding cities; and
WHEREAS, the City finds that despite the existence of appropriate signage prohibiting
and/or restricting the parking or standing of vehicles in certain streets and portions thereof, and
despite continued issuance of parking citations imposing a minimal fine for violation of Section
22-174, motorists continue to park unlawfully with high frequency in certain of these areas,
thereby causing incessant traffic and parking congestion for residents and merchants living and
doing business in said areas; and
WHEREAS, in order to more effectively address the problem of excessive and repeated
unlawful parking on certain streets and portions thereof, the City desires to establish
"Neighborhood Parking Protection Zones," which, by resolution, will be named as such and
which will result in enhanced penalties for violation of Section 22-174 in said zones; and
WHEREAS, the City finds that penalties for parking violations in the areas of the
proposed Parking Protection Zones which are currently standardized with those of issuing
agencies in Los Angeles County do not adequately serve to deter the problem of parking
violations; and
WHEREAS, the City finds that the authority to establish "Neighborhood Parking
Protection Zones" is necessary to deter continued parking violations and to restore and maintain
the safety, morals and welfare of the community
NOW, THEREFORE, the City Council of the City of West Covina does hereby ordain as
follows:
SECTION 1: Section 22-199 of the West Covina Municipal Code is hereby added to
read as follows:
"Sec. 22-199. Establishment of Neighborhood Parking Protection Zones; Enhanced
penalties.
Upon the finding that certain streets and/or portions thereof marked with signage
prohibiting or restricting parking or standing of vehicles on said streets or portions
thereof continue to incur excessive and repeated violations despite the issuance of
citations resulting in penalties standardized in amount with those of other agencies in the
County of Los Angeles, the City Council may by resolution, designate said streets and or
portions thereof, as "Neighborhood Parking Protection Zones" and establish and adopt a
schedule of enhanced penalties for said violations."
SECTION 2: Severability. If any provision of this ordinance is held to be invalid,
void, or unconstitutional, it is the intent of the City Council that such invalidated portion be
severable from the remainder and that the remainder be given full force and effect.
SECTION 3: The City Clerk shall certify to the passage and adoption of this ordinance,
causing it to be posted as required by law, and it shall be effective (30) days after its adoption.
