AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, AMENDING CHAPTER 26 (ZONING) OF THE
WEST COVINA MUNICIPAL CODE RELATED TO AUTOMOBILE
• INSTALLATION IN THE "NEIGHBORHOOD COMMERCIAL" (N-C)
ZONE (CODE AMENDMENT NO. 01-05)
WHEREAS, Code Amendment No. 01-05 is a City -initiated code amendment related to
automobile installation activities in the "Neighborhood Commercial' (N-C) Zone; and
WHEREAS, the Planning Commission, upon giving required notice, did on the 29`h day
of January, 2002, conduct a duly advertised public hearing as prescribed by law, at which time
the Planning Commission adopted Resolution No. 02-4719 recommending to the City Council
approval of Code Amendment No. 01-05; and
WHEREAS, the City Council considered evidence presented by the Planning
Commission, Planning Department, and other interested parties at a duly advertised public
hearing on the 19`h day of February, 2002; and
WHEREAS, studies and investigations made by this Council and in its behalf reveal the
following facts:
"The purpose of the Neighborhood Commercial Zone is to classify and set standards for
those retail and service commercial uses which by their nature are of moderate intensity; are
necessary in order to provide convenient daily shopping facilities to residential home and
apartment dwellers; and are generally adjacent to or within close proximity to residential
zoning or development and, therefore, require extraordinary physical treatment in order to
guarantee compatibility with and protection to surrounding properties and their values."
2. The "Neighborhood Commercial' Zone currently allows auto supply stores, but does not
allow the installation of automobile accessories (e.g. car stereos). Auto supply stores
with installation could have the potential to impact adjacent residential areas as a result of
installation activities. The primary impact of car stereo installation on neighboring
properties and businesses is noise generated by the testing of newly installed stereo
equipment.
3. Section 26-597 of the Zoning Code requires that all service and trade uses (including
automobile installation) be conducted within an enclosed building. Compliance with the
Zoning Code will therefore ensure that automobile accessory businesses with installation
conduct installation activities within enclosed buildings.
NOW, THERFORE, the City Council of the City of West Covina, California, does hereby
ordain as follows:
SECTION NO. 1: Based on the evidence and the findings set forth, Code Amendment
No. 01-05 is hereby found to be consistent with the West Covina General Plan and the
implementation thereof.
SECTION NO. 2: The proposed action is considered to be exempt from the provisions of
the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the
CEQA Guidelines, in that the proposed action consists of a code amendment, which does not
have the potential for causing a significant effect on the environment.
SECTION NO. 3: The City Council of the City of West Covina hereby amends Chapter 26
of the West Covina Municipal Code to read as shown on Exhibit "A."

SECTION NO. 4: The City Clerk shall certify to the passage of this Ordinance and shall
cause the same to be published as required by law.

No building or improvement or portion thereof shall be erected, constructed, converted,
