Ordinance - 2078ORDINANCE NO. 2078 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA REPEALING SECTION 15-32 OF ARTICLE II OF CHAPTER 15 OF THE WEST COVINA MUNICIPAL CODE REGARDING THE PROHIBITION OF SELLING SATURDAY NIGHT SPECIALS WHEREAS, in November 1996 the West Covina City Council adopted an ordinance to prohibit the sale of certain firearms know as "Saturday Night Specials"; and WHEREAS, the West Covina City Council prohibited the sale of "Saturday Night Specials" in 1996 because the Federal Gun Control Act of 1968 did not ban the selling of "Saturday Night Specials" within the United States; and WHEREAS, the West Covina City Council and cities throughout California passed similar ordinances to prohibit the sale of "Saturday Night Specials" because of the increase in crimes committed with "Saturday Night Specials" and to protect the public from poor manufacturing typical of"Saturday Night Specials'; and WHEREAS, the State of California SB-15 (Penal Code § 12125, et Seq.) in 1999 which regulates "unsafe handguns" and supersedes Section 15-32 (Saturday Night Specials, Sales Prohibited) of Article II (Firearms) of Chapter 15 (Mist. Provisions Relating to Public Health and Safety) of the West Covina Municipal Code. Chapter 15. NOW, THEREFORE, the City Council of the City of West Covina does hereby ordain as follows: SECTION NO. 1: Section 15-32 of Article II of Chapter 15 of the West Covina Municipal Code, concerning the prohibition of "Saturday Night Specials" is repealed in its entirety. SECTION NO. 2: The City Clerk shall certify as to the passage of this ordinance and shall cause the same to be published as required by law, and it shall be effective 30 days from the date of passage of this ordinance.
