ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA REPEALING ARTICLE III OF CHAPTER 14 OF THE WEST
COVINA MUNCIPAL CODE, SECTIONS 14-81THROUGH 14-88
. (ORDINANCE NO. 1210), RELATING TO THE"BUSINESS
IMPROVEMENT AREA OF THE CITY OF WEST COVINA" AND THE
LEVY OF LICENSE TAXES ON THE BUSINESSES IN SUCH AREA
WHEREAS, in 1972, the West Covina City Council (the "City Council") approved the
creation of the "Business Improvement Area of the City of West Covina" (the "Area"), and
approved the imposition of an additional business license tax upon the businesses within the
Area; and
WHEREAS, the proceeds of the additional business license tax were to be used for the
general promotion of retail trade activities in the Area; and
WHEREAS, the City Council now desires to eliminate the additional tax imposed upon
the business in the Area.
NOW, THEREFORE, the City Council of the City of West Covina does hereby ordain as
follows:
SECTION NO. 1: Article III of Chapter 14 of the West Covina Municipal Code,
Sections 14-81 through 14-88, concerning the "Business Improvement Area of the City of West
Covina" and the levy of license taxes on the businesses in such Area is repealed in its entirety.
SECTION NO. 2: Severability. The City Council hereby declares that it would have
passed this Ordinance sentence by sentence, paragraph by paragraph, and section by section, and
does hereby declare that the provisions of this Ordinance are severable, and if, for any reason,
any sentence, paragraph or section of this Ordinance shall be held invalid, such decision shall not
affect the validity of the remaining parts of this Ordinance.
SECTION NO.3: The City Clerk shall certify as to the passage of this Ordinance and shall
cause the same to be published as required by law, and it shall be effective on August 1, 2001.
Notwithstanding the effective date of this Ordinance, any business license taxes levied prior to the
effective date of this Ordinance pursuant to Article III of Chapter 14 of the West Covina Municipal
Code, Sections 14-81 through 14-88, including any penalties associated therewith, shall remain fully
due and payable to the City of West Covina.
