AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA AMENDING ARTICLE VII (PURCHASES
AND SALES) BY INCREASING THE DOLLAR LIMITS AS DEFINED
• IN SEC. 2-330, SEC. 2-331, SEC. 2-333 AND SEC. 2-334 OF THE WEST
COVINA MUNICIPAL CODE
WHEREAS, it is deemed to be in the City's best interest to purchase goods and service
more effectively; and
WHEREAS, the purchasing bid limits as defined in the Municipal Code of the City of
West Covina were last modified March 8, 1976; and
WHEREAS, City Council has directed staff to implement the recommendations set forth
in the "Finance Department Review" presented by Moreland and Associates.
NOW, THEREFORE, be it ordained by the Council of the City of West Covina as
follows:
SECTION 1. That Section 2-330 (Bidding) paragraph (b) of Article VII (Purchases and
Sales) of the West Covina Municipal Code, is hereby amended to read as follows:
See.2-330. Bidding.
(b) Bidding may be dispensed with when an emergency requires that an order be placed
with the nearest available source of supply, when the amount involved is less than one thousand
dollars ($1,000) or when the commodity can be obtained from only one vendor. The city
council, by majority vote of its entire membership, may dispense with such bidding and other
procedures required by this division in any individual instance upon finding that it would be
impracticable, useless or uneconomical in such instance to follow such procedures and that the
public welfare would be promoted by dispensing with the same.
SECTION 2. That Section 2-331 (Purchase orders) of Article VII (Purchases and Sales)
of the West Covina Municipal Code, is hereby amended to read as follows:
Sec. 2-331. Purchase orders.
Purchases of supplies, services and equipment of a value greater than $1,000 shall be
made only by purchase order according to rules prescribed by the city manager,
SECTION 3. That Section 2-333 (Formal contract procedure) of Article V11 (Purchases
and Sales) of the West Covina Municipal Code, is hereby amended to read as follows:
Sec. 2-333. Formal contract procedure.
Except as otherwise provided herein, purchases and contracts for supplies, services and
equipment of a value greater than twenty five thousand dollars ($25,000.00) shall be by written
contract with or written purchase order to the lowest responsible bidder, pursuant to the
procedure prescribed herein:

is SECTION 4. That Section 2-334 (Purchases of less than twenty five thousand dollar
value) of Article VII (Purchases and Sales) of the West Covina Municipal Code, is hereby
amended to read as follows:
Sec. 2-334. Purchases of less than twenty five thousand dollar value.
Purchases of supplies and equipment of an estimated value of less than twenty five
thousand dollars ($25,000.00) may be made by the purchasing officer in accordance with the
procedures set forth in this section without compliance with the formal contract procedure set
forth in section 2-333. The purchasing officer shall solicit competitive bids for all such
purchases pursuant to the procedure prescribed herein:
• (a) Except where competitive bidding is not required, bids shall be solicited for purchases of
supplies or equipment and awarded to the lowest responsible bidder, as defined in
subsection (a) of section 2-333 as follows:
(1) For purchases of less than twenty five thousand dollars ($25,000.00) and more than
ten thousand dollars ($10,000.00), at least three (3) verbal or written bids shall be
obtained and require the approval of the requesting Department i-lead, Finance
Director, and City Manager; and
(2) For purchases of ten thousand dollars ($10,000.00) or less, but more than one
thousand dollars ($1,000.00), a minimum of three (3) bids shall be obtained, verbal or
written, and shall require the approval of the requesting Department Head and
Finance Director.
(b) The purchasing officer shall keep a record of all open market orders and bids for a period
of one (1) year after the submission of bids or placing of orders. This record shall be open
to the public.
(c) The competitive bidding procedures set forth in this section may be waived in the
following circumstances:
(1) While striving to obtain the best pricing for the city, the purchase has an estimated
value of less than one thousand dollars ($1,000.00)
(2) In the case of a purchase of less than twenty five thousand dollars ($25,000) but more
than ten thousand dollars ($10,000.00), where the city manager finds that it is in the
public interest and necessity to make the purchase without competitive bidding, or
that there is only a single source of supply, or that it is impractical to do so; and
(3) In the case of a purchases of ten thousand dollars ($10,000.00) or less where the
purchasing officer finds that it is in the public interest and necessity to make the
purchase without competitive bidding, or that there is only a single source of supply,
or that it is impractical to do so.
SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance,
causing it to be posted as required by law, and it shall be effective thirty (30) days after its
adoption.
