Ordinance - 2064ORDINANCE NO. 2064 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING SECTION 15-223(A)(1) AND • SECTION 15-224(C) OF THE WEST COVINA MUNICIPAL CODE REGARDING THE SERVICE OF NOTICES OF CORRECTION AND ADMINISTRATIVE CITATIONS. • The City Council of the City of West Covina does hereby ordain as follows: Section 1. The City Council finds: A. That pursuant to Government Code §53069.4 the legislative body of a local agency may adopt or amend an ordinance that makes any violation of any ordinance of the agency subject to an administrative fine or penalty; and B. That pursuant to Government Code §53069.4 the legislative body of a local agency may set forth by ordinance the administrative procedures that shall govern the imposition, enforcement, collection, and administrative review by the local agency of those administrative fines or penalties; and C. That because the City desires to enforce the West Covina Municipal Code in the most efficient manner possible, this ordinance amends an administrative procedure for the service of administrative fines of the West Covina Municipal Code; and D. That West Covina Municipal Code Section 1-27 allows notices to be served by regular first class mail. Section 2. Section 15-223(a)(1) of Article XI of Chapter 15 of the West Covina Municipal Code, is hereby amended to read as follows: 15-223 Administrative Citation (a) Issuance of Administrative Citation. Except as set out in section 15-224 for correction conditions, an enforcement official may, upon determining that a person has committed a municipal ordinance violation hereinafter referred to as "responsible party", issue an administrative citation to the responsible party using the procedures set out herein. 1. As used herein, "responsible party" shall mean the occupant or owner of the property or the person otherwise responsible for complying with Code requirements. The administrative citation shall be served by personal service on the Responsible Party or in accordance with the provisions of section 1-27 of this code. The responsible party's refusal to accept the administrative citation shall not affect the validity of the administrative citation or any proceeding undertaken under this Chapter. Section 3. Section 15-224(c) of Article XI of Chapter 15 of the West Covina Municipal Code, is hereby amended to read as follows: 15-224 Correction Notice (c) Correction Notice. Upon discovery of a correction condition, the enforcement official shall issue a written correction notice to the responsible party Ordinance No. 2064 is 0 by personal service or in accordance with the provisions of Section 1-27 of this code. The responsible party's refusal to accept the correction citations(s) shall not affect the validity or any other proceeding set forth in this article. Section 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. The effective date of this ordinance is January 11, 2001.
