Ordinance - 2061ORDINANCE NO. 2061 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 26 (ZONING) OF THE WEST COVINA MUNICIPAL CODE RELATED TO "DEVELOPER AND/OR • FUTURE USE SIGNS" (Code Amendment No. 296) WHEREAS, Code Amendment No. 296 is a City -initiated code amendment related to "developer and/or future use signs"; and WHEREAS, the Planning Commission, upon giving the required notice, did on the llth day of September, 2000, conduct a duly advertised public hearing as prescribed by law, at which time the Planning Commission adopted Resolution No. 09-00-4646 recommending to the City Council approval of Code Amendment No. 296; and WHEREAS, the City Council considered evidence presented by the Planning Commission, Planning Division, and other interested parties at a duly advertised public hearing on the 27th day of September, 2000; and WHEREAS, studies and investigations made by this Council and in its behalf reveal the following facts: 1. Section No. 26-370 (a) of West Covina Municipal Code specifically requires a grading or building to be issued prior to authorization of a "future use" sign. 2. The proposed amendment to Chapter 26 of the West Covina Municipal Code (Zoning) would further allow "future use" signs on redevelopment project sites upon execution of a disposition and development agreement. 3. Allowing "future use" signs upon execution of a disposition and development agreement is desirable in that it would serve to inform the public early about an upcoming redevelopment project and provide more flexibility within the Code to allow for such signs. 4. The proposed Code amendment is not anticipated to result in any negative or adverse impacts as it does not change the present restrictions on size, shape or design allowed for "future use" signs and will continue to require removal of such signs upon clearance for occupancy or after two years, whichever is sooner. 5. The proposed action is considered to be exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines, in that the proposed action consists of a code amendment which does not have the potential for causing a significant effect on the environment. NOW, THERFORE, the City Council of the City of West Covina, California, does hereby ordain as follows: SECTION NO. 1: Based on the evidence and the findings set forth, Code Amendment • No. 296 is hereby found to be consistent with the West Covina General Plan and the implementation thereof. SECTION NO.2: The proposed action is considered to be exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines, in that the proposed action consists of a code amendment which does not have the potential for causing a significant effect on the environment.
