AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, AMENDING
SECTION 15-95 OF THE WEST COVINA MUNICIPAL
CODE RELATING TO CONSTRUCTION AND BUILDING
MATERIALS.
• THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN
AS FOLLOWS:
SECTION 1. The City Council of the City of West Covina
does hereby find, determine and declare that:
A. That the City has received complaints
regarding intolerable noise levels attributable
to the loading and unloading of construction
equipment near occupied residences; and
B. That the current provisions of the
West Covina Municipal Code do not adequately
respond to such unloading and loading activities;
and
C. That in order to mitigate the effect of
such noise levels, the West Covina Municipal
Code must be amended to reflect a prohibition of
such activities in areas generally occupied by
residents; and
D. That the public interest, convenience and
necessity, require the adoption of this Ordinance.
SECTION 2. That subparagraph (C) of Section 15-95
shall be, and hereby is, added as follows:
"(C) Unloading and Loading. Between
the hours of 8:00 P.M. of one
day and 6:00 A.M. of the next
day, it shall be unlawful for
any person within the radius of
500 feet of generally occupied
residences to unload, load or
otherwise perform duties pre-
paratory to the commencement of
construction or repair work on
buildings or structures. Gen-
erally occupied residences shall
include, but not be limited to,
areas in which there is a reason-
able probability of occupancy
within the area."
SECTION 3. The City Clerk shall certify to the passage
of this ordinance and shall cause the same to be published as
required by law.
