ORDINANCE NO. 1825
AN ORDINANCE OF THE_ CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING THE WEST
COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL
ZONING MAP (Zone Change No. 626 - Frank DePietro
and Sons)
•WHEREAS, there was filed with the City of West Covina a verified
application on the forms prescribed in Section 26-153 and 26-199 of
the West Covina Municipal Code, for the reclassification from:
•
"Service Commercial (S-C)" and "Single -Family
Residential (R-1), Area District I" to
"Office-Profesional (0-P)" (Exhibit 1).
on that certain property generally described as follows:
Parcel 18 on Page 24 of Map Book 8458 and
Parcels 11 and 27 on Page 25 of Map Book 8458 of
the Los Angeles County Assessor's Records; and
WHEREAS, after considering the proposed request in a duly
advertised public hearing on October 4, 1989, as prescribed by law,
the Planning Commission of the City of West Covina recommended that
the City'Council approve said zone change; and
WHEREAS, the City Council of West Covina has considered evidence
presented by the applicant, the Planning Department, the Planning
Commission, and other interested parties at said public hearing held
on October 30, 1989; and
WHEREAS, the oral and documentary evidence considered in
connection with application reveal the following facts:
1. The applicant is requesting approval of a zone change from
"Service Commercial (S-C)" and "Single Family Residential
(R-1), Area District I" to "Office -Professional (0-P)."
2. This zone change application is submitted in conjunction
with a request for an amendment to the General Plan land
use designation from "Low -Medium Density Residential" to
"Service and Neighborhood Commercial" and a request for a
tentative parcel map.
3. Findings necessary for approval of a zone change are as
follows:
a. There are changed conditions since the existing zoning
became effective to warrant other or additional
zoning.
b. The proposed change of zone will not adversely affect
adjoining property as to value or precedent and will
not be detrimental to the area.
C. A change of zone will be in the interest or
furtherance of the public health, safety and general
welfare.
d. The approval of such a change of zone will not
adversely affect the comprehensive General Plan so
adopted by the City.
e. The approval of such a zone change is consistent with
the General Plan or applicable specific plans.

WHEREAS, based on the evidence presented to the City Council,
both oral and documentary, the City Council finds as follows:
1. The current zoning has been in place for twenty years.
Since the original construction of the homes to the north
of the subject property, the immediate area has undergone
changes, including the widening of the San Bernardino
Freeway (Interstate 10), the adoption of the Central
Business District Redevelopment Area and a subsequent trend
toward more intense development of the property in the
central business district and particularly along the I-10
Freeway. The proposed zone change would allow for the
development of the site as offices. Considering these
changes, the proposed "Office -Professional" designation is
appropriate.
2. The proposed zone change will not adversely affect
adjoining properties. The use of the site for office
purposes is the best use for the site as it allows for a
low intensity, commercial type use that will benefit the
City through jobs and increased revenues, and will buffer
the residential area to the north from noise generated by
the I-10 Freeway.
3. The proposed change of zone is in the interest of public
health, safety and general welfare as it will promote
employment, add to the tax base, promote economic stability
in the community, and protect the adjacent residential area
from traffic noise generated by the freeway.
4. The granting of this zone change will not adversely affect
the General Plan, but will be consistent with the proposed
General Plan designation for the site. Additionally, the
zone change will act to implement many goals and policies
within the General Plan which call for uses and facilities
to serve the residents of the City and strengthen the
employment and economic base within the City.
5. The proposed change from "Service Commercial, S-C" and
"Single -Family Residential, R-1, A.D.I." to
"Office -Professional, O-P" is consistent with the proposed
General Plan designation of "Service and Neighborhood
Commercial."
NOW, THEREFORE, the City Council of the City of West Covina,
California, does ordain as follows:
