Ordinance - 1792• ORDINANCE NO. 1792 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 614 - West Covina Nissan) WHEREAS, there was filed with the City of West Covina application on the forms prescribed in Chapter 26, Article the West Covina Municipal Code, for a change of zone from: "Single -Family Residential (R-1) Zone" to "Service Commercial (S-C) Zone." on that certain property generally described as follows: a verif ied VI, of That portion of Lot 26, Tract 18268, in the City of West Covina, County of Los Angeles, State of California, as per map recorded in Book 451, Pages 24 and 25 of Maps, in the Office of the County Recorder of said County, lying southeasterly of the following described line: Beginning at the most northerly corner of Parcel 4 of Parcel Map No. 436 as shown on map recorded in Book 10, Page 64 of Parcel Maps, in said office; thence southwesterly along the northwesterly line of said Parcel 4, said line being a curve concave southeasterly and having a radius of 1,258 feet through an angle of 10 degrees, 14 minutes, 59 seconds, an arc distance of 225.04 feet; thence leaving said northwesterly line south 39 degrees, 38 minutes, 55 seconds east 0.15 feet to a curve concave southeasterly and having a radius of 170 feet; thence southwesterly along last said curve from a tangent which bears south 48 degress, 6 minutes, 36 seconds west through an angle of 38 degrees, 51 minutes, 36 seconds, a distance of 115.30 feet; thence tangent to last said curve south 9 degrees 15 minutes 00 seconds west, 98.33 feet to a tangent curve concave northwesterly and having a radius of 230 feet; thence southwesterly along last said curve through an angle of 81 degrees 10 minutes, 10 seconds, an arc distance of 325.84 feet; thence tangent to last said curve north 89 degrees, 34 minutes, 50 seconds, west 14 feet to a point in the easterly line of Lot 38 of said Tract 18268 distant thereon south 0 degrees 25 minutes, 10 seconds west, 5.84 feet from the northeast corner of last said lot; and Lots 21, 22, 23, 24 and 25 of Tract No. 18268 as per map recorded in Book 451, Pages 24 and 25 of Maps in the Office of the County Recorder of said County. WHEREAS, after considering the proposed request in a duly advertised public hearing on July 20, 1988, as prescribed by law, the Planning Commission of the City of West Covina, recommmended that the City Council approve said zone change application; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission, and other interested parties at said public hearing held on August 22, 1988; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The applicant is requesting approval of a zone change from "Single -Family Residential (R-1) Zone (Exhibit 1)" to "Service Commercial (S-C) Zone;" and Page 2 Ordinance 1792 2. This zone change application is submitted in conjunction with a request for an amendment to the General Plan and land use designation from "Low Medium Residential" to "Service and Neighborhood Commercial;" and WHEREAS, based on the evidence presented to the City Council is both oral and documentary, the City Council finds as follows: 1. The proposed zone change is consistent with the proposed General Plan land use designation of "Service and Neighborhood Commercial." Additionally, the zone change will act to implement many goals and policies within the General Plan which call for uses and facilities which will serve the residents of the City and strengthen the employment base within the City. 2. The proposed zoning provides for strict standards and criteria for development to minimize the impact on neighboring properties and land uses. 3. The proposed change of zone is in the interest of public health, safety and general welfare as it will allow for an expansion of Auto Row which will serve to strengthen the economic base of the City. The proposal will also provide a buffer between the noise and traffic impacts generated by the I-10 Freeway to the residential area adjacent to Auto Row. NOW, THEREFORE, the City Council of the City of West Covina, California, does resolve as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth, the above Zone Change No. 614 is hereby found to be consistent with the City's General Plan and appropriate for the proposed development concept and the land uses permitted witin said zone classification. SECTION NO. 2: An Environmental Impact Report has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. SECTION NO. 3: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 10th day of October , 1988.
