Ordinance - 1791ORDINANCE NO. 1791 C� E AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 613 - Bozzani Motor Car Company) WHEREAS, there was filed with the City of West Covina a verified application on the forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, for a change of zone from: "Single -Family Residential Zone (R-1)", to "Service -Commercial (S-C)" Zone on that certain property generally described as follows: That portion of Lot 27, Tract 18268, in the City of West Covina, County of Los Angeles, State of California, as per map recorded in Book 451, Pages 24 and 25 of Maps, in the Office of the County Recorder of said County, lying southeasterly of the following described line: Beginning at the most northerly corner of Parcel 4 of Parcel Map No. 36 as shown on map recorded in Book 10, Page 64 of Parcel Maps, in said office; thence southwesterly along the northwesterly line of said Parcel 4, said line being a curve concave southeasterly and having a radius of 1,258 feet through an angle of 10 degrees, 14 minutes, 59 seconds, an arc distance of 225.04 feet; thence leaving said northwesterly line south 39 degrees, 38 minutes, 55 seconds east 0.15 feet to a curve concave southeasterly and having a radius of 170 feet; thence southwesterly along last said curve from a tangent which bears south 48 degrees, 6 minutes, 36 seconds west through an angle of 38 degrees, 51 minutes, 36 seconds, a distance of 115.30 feet; thence tangent to last said curve south 9 degrees 15 minutes 00 seconds west, 98.33 feet to a tangent curve concave northwesterly and having a radius of 230 feet; thence southwesterly along last said curve through an angle of 81 degrees 10 minutes, 10 seconds, an arc distance of 325.84 feet; thence tangent to last said curve north 89 degrees, 34 minutes, 50 seconds, west 14 feet to a point in the easterly line of Lot 38 of said Tract 18268 distant thereon south 0 degrees 25 minutes, 10 seconds west, 5.84 feet from the northeast corner of last said lot; and Lots 37 of Tract No. 18268, in the City of West Covina, in the County of Los Angeles, State of California, as per map recorded in Book 451, Pages 24 and 25 of Maps in the Office of the County Recorder of said County. Lot 38 of Tract No. 18268, in the City of West Covina, in the County of Los Angeles, State of California, as per map recorded in Book 451, Pages 24 and 25 of Maps, in the Office of the County Recorder of said County. • 0 Page 2 Ordinance 1791 Excepting therefrom that portion described as follows: Beginning at the northwesterly corner of said Lot 38; thence easterly along the northerly line of said lot, south 89 degrees, 34 feet, 50 inches east, 116 feet to the northeasterly corner of said lot; thence southerly along the easterly line of said lot, south 6 degrees, 25 feet, 10 inches, west to a line which is parallel with and distant southerly 5.84 feet from said northerly line; thence westerly along said parallel line north 89 degrees, 34 feet, 50 inches west, 91 feet to the beginning of a tangent curve concave southeasterly and having a radius of 25 feet; thence westerly and southwesterly along said curve through an angle of 90 degrees 00 feet, 00 inches, a distance of 39.27 feet to its point of tangency with the westerly line of said lot 38; thence northerly along said westerly line north 00 degrees, 25 feet, 10 inches east, 30.84 feet to the point of beginning. Lot 28 of Tract 18268 in the City of West Covina, in the County of Los Angeles, State of California, as per map recorded in Book 451, Pages 24 and 25 of Maps, in the Office of the County Recorder of said County. WHEREAS, after considering the proposed request in a duly advertised public hearing on July 20, 1988, as prescribed by law, the Planning Commission of the City of West Covina recommended that the City Council approve said zone change application; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission and other interested paraties at said public hearing held on August 22, 1988; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The aplicant is requesting approval of a zone change from "Single -Family Zone (R-1) (Exhibit 1)" to "Service -Commercial (S-C", 2. This zone change application is submitted in conjunction with a request for an amendment to the General Plan Land Use designation from "Low -Medium Residential" to "Service and Neighborhood -Commercial"; WHEREAS, based on the evidence presented to the City Council, both oral and documentary, the City Council finds as follows: 1. The proposed zone change is consistent with the proposed General Plan Land Use designation of "Service and Neighborhood - Commercial". 2. The proposal will allow for exposure of Auto Plaza to Azusa Avenue, creating a definite entry into Auto Plaza. 3. The zone change will act to implement many goals and policies within the General Plan which call for uses and facilities which will serve the residents of the City. It will strengthen the employment base within the City. 4. The extension of Azusa Avenue in 1967 has changed the character of the street from a local street to a major north/south route, and has impacted the homes in the area. The introduction of commercial uses fronting on Azusa will serve as a buffer to the residential units east of the proposed development, thus furthering the goal of protecting neighborhoods from the effects of harmful and unnecessary vehicular traffic. Page 3 Ordinance 1791 NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION NO. 1: Based on the evidence presented and the findings • set forth, the above Zone Change No. 613 is hereby found to be consistent with the City's General Plan and appropriate for the proposed development concept and the land uses permitted within said zone classification. SECTION NO. 2: An Environmental Impact Report has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. SECTION NO. 3: The City Clerk shall certify to the adoption of this Resolution.
