AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, PROHIBITING
THE SALE AND USE OF SAFE AND SANE FIREWORKS
• THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 10-21 of the West Covina Municipal Code is
amended by deleting the amendment therein to Section 78.102 of°the Uniform
Fire Code, 1985 Edition.
SECTION 2. Section 10-21 of the West Covina Municipal Code is
amended by.deleting the amendments therein to Article 78 of the Uniform
Fire Code, 1985 Edition, and substituting in their place the following:
"Article 78 of the Uniform Fire Code, 1985 Edition is amended
by adding section as follows:
"Section 78.107. Public Displays.
"Permit required. The City,Council may permit any person
to make a public display of fireworks, and for that purpose
to use and discharge fireworks at such times and such places in the
City as the City Council may fix and establish, provided that a
written application for a permit to do so is filed with the
Chief of the Fire Department of the City at least 15 days in
advance of the date of the display. It shall be the duty of the
Chief of the Fire Department to whom the application for a per-
mit is made to make an investigation and submit a report of his
findings and his recommendations for or against reasons therefor,
to the City Council. The City Council shall have power in its
discretion to grant or deny the permit. If the permit is
granted, the applicant shall furnish the City with a certificate
of insurance in adequate amount which shall also contain a clause
holding the City harmless from any damage or injury resulting
from granting the permit."
SECTION 3. Article III is added to Chapter 15 of the West Covina
Municipal Code to read as follows:
"ARTICLE III. FIREWORKS
"Section 15-62. Prohibition of Safe and Sane Fireworks.
"The sale, use and discharge of safe and sane fireworks is
prohibited within the City."
SECTION 4. Section 26-607 of the West Covina Municipal Code is
deleted.
SECTION 5. The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published as required by law.
