Ordinance - 1784ORDINANCE NO. 1784 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING • THE OFFICIAL ZONING MAP (Zone Change No. 612 - Banks Development Corporation) WHEREAS, there was filed with the City of West Covina a verified application on the forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, for a change of zone from: "Single -Family Residential Zone (R-1)", to "Neighborhood - Commercial (N-C)" Zone on that certain property generally described as follows: Lots 19, 20 and 21 of Tract 11502, in the City of West Covina, County of Los Angeles, State of California, as recorded in Book 234, Pages 37 and 38, in the Office of the County Recorder of said County; and WHEREAS, after considering the proposed request in a duly advertised public hearing on July 20, 1988, as prescribed by law, the Planning Commission of the City of West Covina recommended that the City Council approve said zone change application; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission, and other interested parties at a public hearing held on August 8, 1988; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The applicant is requesting approval of a zone change from "Single -Family (R-1) Zone (Exhibit 1)" to "Service -Commercial (S-C)" Zone. 2. The proposed zone change is consistent with the general plan designation of "Service and Neighborhood Commercial" and the Westside Area Plan designation of "Neighborhood Commercial." 3. The subject zone change application was filed in conjunction with Tentative Parcel Map No. 19774, Precise Plan No. 807, and Variance No. 618. WHEREAS, based on the evidence presented to the City Council both oral and documentary, the City Council finds as follows: 1. The single family residential uses on the subject site were in existence prior to World War II. Since that time changes in character of the area, most notable the construction of the San Bernardino Freeway, have impacted the area. The Westside Area Plan, adopted in 1984, provides for a commercial area fronting on Garvey Avenue adjacent to the San Bernardino Freeway. The General Plan also calls for commercial uses in this area as the highest and best use for the properties fronting on the freeway. Page 2 2. The subject site falls within the Westside Area and is subject to the Zoning Ordinance and the guidelines of the Westside Area Plan. The Area Plan addresses issues and sets forth policies specific to the Westside. The Plan was developed by a citizens' committee in conjunction with City staff. The proposal meets or exceeds the criteria established in the Zoning Ordinance and Westside Area Plan and in doing so, will not adversely affect or be detrimental to the area. 3. The proposed change of zone is in the interest of public health, safety and general welfare as it will promote employment, add to the tax base, promote economic stability in the community, and protect the adjacent residential area from noise and traffic generated on Garvey Avenue and the San Bernardino Freeway. 4. The granting of this Zone Change will not adversely affect the General Plan, but will be consistent with the General Plan and Westside Area Plan designations for the site. Additionally, the zone change will act to implement many goals and policies within the General Plan which call for uses and facilities which will serve the residents of the City, and strengthen the employment and ecomomic base within the City. 5. The proposed Zone Change from "Single -Family Residential (R-1)" to "Neighborhood Commercial (N-C)" is consistent with the General Plan designation of "Service and Neighborhood Commercial" and the Westside Area Plan designation of "Neighborhood Commercial." NOW, THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth, the above Zone Change No. 612 is hereby approved as consistent with the City's General Plan and appropriate for the proposed development concept and the land uses permitted within said zone classification. SECTION NO. 2: A Negative Declaration of Environmental Impact has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. SECTION NO. 3: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
