Ordinance - 1776ORDINANCE NO. 1776 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING SECTION 16-18(e) AND SECTION 22-77 AND ADDING SECTIONS 22-80 THROUGH 22-82 TO THE WEST COVINA MUNICIPAL • CODE RELATING TO THE RIDING AND PARKING OF SKATEBOARDS, ROLLER SKATES, COASTERS, AND SCOOTERS THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. Article III of Chapter 22 of the West Covina Municipal Code is hereby amended by adding the following definitions to Section 22-77: Bicycle - A "Bicycle" shall be that defined by Vehicle Code Section 231. Business District - A "Business District" shall be that defined by Vehicle Code Sections 235 and 240. Sidewalk - A "Sidewalk" shall be that defined by Vehicle Code Section 555. Place of Public Assembly - "Place of Public Assembly" V includes all buildings or areas where persons congregate from time to time, including but not limited to, the West Covina .Civic Center, any community or senior citizens center, and any school, church, temple, or assembly hall. SECTION 2. Article III of Chapter 22 of the West Covina Municipal Code is hereby amended by adding Sections 22-80 through 22-82 to read as follows: SECTION 22-80. Skateboard, Rollerskates, Coaster, and Scooter Restrictions. (a) No person may ride upon, propel, or park a skateboard, roller skates, coaster, or scooter on any street or road within the City or on any sidewalk in any business district. (b) Where the prohibition has been posted pursuant to Section 22-82, no person shall, at any time, ride upon, propel, or park a skateboard, roller skates, coaster, or scooter upon any sidewalk in front of any place of public assembly. (c) Where the prohibition has been posted pursuant to Section 22-82, no person may ride upon, propel, or park a skateboard, roller skates, coaster, or scooter in or on a parking lot or structure designed or used for the parking of motorized vehicles. (d) No person shall ride upon, propel, park, or leave any skateboard, roller skates, coaster, or scooter upon any street or road. (e) Where the prohibition has been posted pursuant to Section 22-82, no person shall ride upon, propel, or park a skateboard, roller skates, coaster, or scooter upon any • private sidewalk in a commercial or business complex, including a shopping center. SECTION 22-81. Parking Restrictions. Any skateboard, roller skates, coaster, or scooter illegally parked may be impounded by the police department and returned to the owner under such reasonable conditions as may be established by the Chief of Police. SECTION 22-82. Posting Requirements. The prohibition of riding upon, propelling, or parking skateboards, roller skates, coasters, and scooters has been properly posted if the prohibition is displayed, in plain view at all entrances to the property, on a sign not less than 17 by 21 inches in size, with lettering not less than one inch in height. SECTION 22-83. Exemptions From Regulations. (a) Devices designed, intended, and used solely for the transportation of infants, invalids, or incapacitated persons, or devices designed, intended, and used for the transportation of merchandise to or from the place of purchase, and other wheeled devices, when being used for either of these purposes, shall be exempt from the regulations imposed by this Article. (b) The person in charge of a place of public assembly may permit the use of skateboards, roller skates, coasters, or scooters during hours when the place of public assembly is not open or in use, and the waiver has been posted pursuant to Section 22-82. (c) The provisions of this Article shall not apply where the riding upon, propelling, or parking of skateboards, roller skates, coasters, or scooters is otherwise expressly permitted by State, Federal, or local law. SECTION 3. Section 16-18(e) of the West Covina Municipal Code is amended to read as follows: "(e) Ride upon, propel, or park a skateboard, roller skates, coaster, or scooter where the Traffic Authority has posted signs in the manner set forth in Section 22-82 to prohibit such activity." SECTION 4.
