Ordinance - 1773ORDINANCE NO. 1773 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONIG MAP (Zoning Change No. 599 - Queen of the Valley Hospital) WHEREAS there was filed with theit f City o West Covina a verified application on the forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, for a change of zone from: "Office -Professional (O-P)" to "Specific Plan No. 1 (SP-1)," on that certain property generally described as follows: Parcel Map No. 17372 in the City of West Covina, as recorded in the Office of the County Recorder, County of Los Angeles; and WHEREAS, after considering the proposed request in a duly advertised public hearing on January 20, 1988, and February 3, 1988, as prescribed by law, the Planning Commission of the City of West Covina adopted Resolution No. 2-88-3595 recommending that the City Council approved said zone change application; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission, and other interested parties at said public hearing held on February 22, 1988; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The applicant is requesting approval of a zone change from "Office -Professional (O-P)" to "Specific Plan No. 1 (SP-1)"; and 2. This zone change application is submitted in con- junction with a request for an amendment to the General Plan land use designation from "Office" to "Planned Development"; and 3. The proposed zone change includes a Specific Plan Zoning Text (Exhibit 1), which sets forth development standards and plan approval processes, and a Specific Plan Map, which displays the ultimate development of the site; and 4. A Final Environmental Impact Report and Addendum to the Final Environmental Impact Report were prepared pursuant to the requirements of the California Environmental Quality Act of 1970, as amended; and WHEREAS, based on the evidence presented to the City Council both oral and documentary, the City Council finds as follows: 1. The proposed zone change is consistent with the proposed General Plan land use designation of "Planned Development." Additionally, the zone change will act to implement many goals and policies within the General Plan which call for uses and facilities which will serve the residents of the City and strengthen the employment base within the City. 6 Page 2 2. The proposed zoning, including the Specific Plan Zoning Text and Map, will allow for enhanced health care facilities to serve the city and surrounding region in a manner which minimizes potential impacts on surrounding properties and uses. 3. The proposed zoning provides for strict standards and criteria for development to minimize the impact on neighboring properties and land uses. 4. The proposed zoning can better accommodate the mixture of health care facilities than existing zoning. 5. The propsed change of zone is in the interest of public health, safety and general welfare as it will allow for enhanced health care facilities, serving the community and surrounding region. NOW THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth the above Zone Change No. 599 is hereby approved as consistent with the City's General Plan and appropriate for the proposed development concept and the land uses permitted within said zone classification. SECTION NO. 2: An Environmental Impact Report has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. PURPOSE This Specific Plan Zone is intended to provide for a variety of compatible, medically -oriented uses within a campus setting. It is intended that this development will be integrated carefully with the adjacent neighborhood and reflect the variety of uses 40 that surround it. The objectives of the West Covina General Plan will be enhanced through the implementation of this Specific Plan Zone. This Specific Plan Zone shall include the following text description of development standards, and the approved Specific Plan Map dated 1988. Except as provided herein, this document incorporates by reference all applicable standards and regulations as set forth in the West Covina Municipal Code. II. PERMITTED USES A. The following uses shall be permitted: 1. Hospitals (Human) 2. Medical and Dental Clinics 3. Medical Offices 4. Accessory uses and structures where related and incidental to a permitted use. B. The following uses are permitted only with an Unclassified Use Permit: 1. Day Care Facilities - including, but not limited to, facilities which provide less than 24-hour care for children, adults and disabled (or otherwise handi- capped) persons. 2. Skilled Nursing Facilities 3. Emergency Aircraft Landing Facilities C. The following uses are expressly prohibited: 1. Retail commercial uses, except as permitted by Section II.A.4, as outlined above 2. Residential uses 3. All other uses III. DEVELOPMENT STANDARDS A. Minimum Lot Size The minimum lot size shall be 15,000 square feet. B. Building Height The maximum building height shall be six (6) stories, or eighty (80) feet, whichever is less. Building heights shall conform to the approved Specific Plan Map. Specific Plan Zone 1/Exhibit February 22, 1988 - Page 2 is s C. Building Setbacks Street Front and Street Side Building Setbacks The minimum street front and street side setbacks shall be fifteen (15) feet and the average shall be twenty (20) feet. 2. Interior Side and Rear Building Setbacks a. Adjacent to residential: Minimum setbacks shall be fifteen (15) feet, plus an additional ten (10) feet for every story above one story. b. Adjacent to non-residential: None. D. Parking Requirements Off-street parking shall be provided in compliance with Section 26-581 and 26-582 of the West Covina Municipal Code and shall conform to the requirements set forth in Planning Commission Resolution No. 2513. E. Exterior Lighting Exterior lighting shall not produce spill -over or glare on adjacent uses or property and shall comply with Section 26-570 of the West Covina Municipal Code and Planning Commission Resolution No. 2513. F. Landscaping Landscaping shall be provided in compliance with Section 26-572 of the West Covina Municipal Code. G. Signage Signage shall conform with the provisions for the Office - Professional (O-P) Zone as outlined in Article VII of the West Covina Municipal Code, except that roof signs shall not be permitted. H. Outdoor Storage No outdoor storage shall be permitted. I. Screening All mechanical equipment, service yards, loading docks and ramps, electrical cage enclosures, trash enclosures and storage tanks are to be screened from view by a fence, wall or mature landscaped materials, as per Section 26-568 of the West Covina Municipal Code, excluding that section pertaining to outdoor storage areas. Plans for said screening, including colors, materials, and vegetation shall be submitted to the Planning Director for review and approval. Specific Plan Zone 1/Exhibit February 22, 1988 - Page 3 J. Building Materials and Colors Building materials, colors, finishes and glass treatments are to be coordinated on all exterior building elevations to achieve a continuity of design. All such materials and design elements shall be reviewed and approved per Section IV of this Chapter. O IV. DEVELOPMENT PLAN APPROVAL PROCESS A. As part of any request for development or implementa- tion of any part of this approved Specific Plan, the applicant shall submit a Development Plan for review and approval by the Planning Commission. The Planning Commission shall review the site plan and architectural design of proposed improvements for compliance with the provisions and restrictions of the Specific Plan Zone, the Final Environmental Impact Report, and Addendum thereto, as well as for compatibility with development on the subject property and surrounding properties. The Planning Commission has the right to approve, modify and approve, conditionally approve or reject a Development Plan at a regularly scheduled meeting. The Planning Commission shall require those conditions of approval that are necessary to assure that the development is compatible with development on the subject property and surrounding properties, complies with the provisions and restrictions of this Specific Plan Zone, the Final Environmental Impact Report and Addendum thereto, and protects the public peace, health, safety and general welfare. B. A Development Plan submittal shall specify and include: 1. The location, size, height and type of all structures including signs, walls and fences. 2. The location, size and dimensions of all yards and setbacks and all spaces between structures. 3. The plan of the proposed parking area for the development to which the parking is accessory. The plan shall be drawn to an engineering scale of sufficient size to clearly indicate the proposed development including location, size, shape, design, curb cuts, lighting, drainage, paving, parking stalls, landscaping and other features and appurtenances of the proposed parking lot. 4. The location, dimensions and method of improvement of all property to be dedicated to the public or to public utilities. 5. A preliminary grading and drainage plan, prepared by a registered civil engineer. 6. Examples of proposed architectural treatments in the form of perspectives and elevations. Samples of proposed building materials, colors and other such information requested by the Planning Director or the Planning Commission in evaluating the proposed devlopment shall be provided by the applicant and shall become an integral part of the Development Plan. 7. The location, area and type of landscaping. Specific Plan Zone 1/Exhibit February 22, 1988 - Page 4 V. AMENDMENT TO A DEVELOPMENT PLAN A. The Planning Commission may grant an amendment to an approved Development Plan only after all procedures as set forth for the original application have been met. B. The Planning Director may approve in writing on the approved Development Plan minor modifications when such modifications do not adversely affect the public interest or neighboring properties or substantially alter any approved Development Plan, and so long as such modification would not affect any other conditions of approval. VI. AMENDMENT TO THE SPECIFIC PLAN Minor amendments, as determined by the Planning Director, may be granted by the Planning Commission at a duly -noticed public hearing. Upon recommendation of the Planning Commission, major amendments may be granted by the City Council at a duly -noticed public hearing. Such amendments may be granted only upon the finding that the amendment does not alter the purpose and intent of this approved Specific Plan Zone.
