Ordinance - 1764• ORDINANCE NO. 1764 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 604 - • Jack Mazmanian) WHEREAS, there was filed with the City of West Covina a verified application on the forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, for a change of zone from: Open -Space (O-S) Freeway Corridor Overlay Zone to Office -Professional (0-P) Freeway Corridor Overlay Zone, on that certain property generally described as follows: That 0.43-acre portion of the northerly 250 feet of Lot 72 of Tract No. 930, shown on map recorded in Book 17, Pages 38 and 39 of Maps, in the Office of the Los Angeles County Recorder; and WHEREAS, after considering the proposed request in a duly advertised public hearing on September 2, 1987, and October 21, 1987, as prescribed by law, the Planning Commission of the City of West Covina recommended that the City Council deny said zone change application; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission, and other interested parties at said public hearings held on November 23, 1987, December 21, 1987, and January 11, 1988; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The applicant is requesting approval of a zone change from Open -Space (O-S) Freeway Corridor Overlay to Office - Professional (0-P) Freeway Corridor Overlay Zone. 2. This zone change application is submitted in conjunction with a request for approval of a variance requested by the applicant to allow a lot depth 48 feet less than the minimum required lot depth in the 0-P Zone. 3. The subject zone change application was also filed in conjunction with Precise Plan No. 783, Rev. 1. WHEREAS, based on the evidence presented to the City Council both oral and documentary, the City Council finds as follows: 1. The Freeway Corridor Overlay Zone was adopted to permit controlled development along the freeway, recognizing that excess freeway parcels may be used for commercial purposes, and that such is the case in this development proposal for the construction of an office -professional building; and 0 Page 2 2. That changing the underlying zone from Open -Space to Office -Professional will allow development similar to that in the vicinity, and that further, the Freeway Corridor Overlay Zone provides for strict standards and criteria for development to reduce and mitigate the impact on neighboring property; and 3. This zone change is consistent with the City's General Plan and will enable a project to be developed under • the regulations of the Freeway Corridor Overlay Zone which has the purpose of fulfilling the goals of the land use and environmental quality elements of the General Plan; and 4. The City Council does find that the concept of an office -professional use is consistent with the General Plan as implemented by the Freeway Corridor Overlay Zone. NOW, THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth the above Zone Change No. 604 is hereby approved as consistent with the City's General Plan and appropriate for the proposed development concept and the land uses permitted within said zone classification. SECTION NO. 2: A Negative Declaration of Environmental Impact has been prepared in accordance with the California Environmental Quality Act of 1970, as amended.
