AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, BANNING
NUDITY IN ESTABLISHMENTS WHERE ALCOHOLIC
BEVERAGES ARE SOLD FOR CONSUMPTION ON THE
PREMISES
6411EREAS, the Department of Alcoholic Beverage Control
has determined that the combination of nude dancing
and alcoholic inebriation increases to an unacceptable level
the likelihood of illegal and/or disorderly conduct; and
WHEREAS, such illegal and/or disorderly conduct
is injurious to the citizens of the City; and
WHEREAS, this Ordinance is necessary to decrease
the incidence of crime, disorderly conduct, and juvenile
delinquency; and
WHEREAS, this Ordinance is necessary to prevent
blight and deterioration of the City's neighborhoods; and
WHEREAS, pursuant to Sections 318.5 and 318.6 of
the California Penal Code, the City Council may adopt an
ordinance prohibiting nudity in establishments which serve
alcoholic beverages,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
WEST COVINA DOES ORDAIN AS FOLLOWS:
Section 1. Section 5-60 (g) of the West Covina
P�unicipal Code is hereby repealed.
Section 2. Section 5-60 (g) is hereby added to
the West Covina Municipal Code:
(1) No person shall expose his or her genitals
or buttocks, nor shall any female expose her
breasts, in any establishment in which intoxicating
beverages are sold for consumption on the
premises.
(2) All theaters, concert halls, or other
establishments primarily devoted to theatrical
performances shall be exempt from the provisions
of this Section.
Section 3. The Mayor shall sign and the City
Clerk shall certify to the passage and adoption of
this Ordinance and shall cause the same to be published
in the manner prescribed by law.
