Ordinance - 1730ORDINANCE NO. MO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, EXTENDING AN INTERIM ORDINANCE RELATING TO ADULT BUSINESSES ON PROPERTY WITHIN ALL ZONES. (Urgency Measure) The City Council of the City of West Covina does ordain as follow : SECTION 1: That the City Council of the City of West Covina does hereby find, determine and declare as follows: a. That Interim Ordinance No. 1722, was adopted on June 23, 1986, to allow a sufficient period of time for the City's Planning Department and Planning Commission to make a complete study and review as to the precise nature of permanent zoning regulations to be imposed in connection with adult businesses in order to protect existing commercial and residential areas in the City from adverse downgrading and deleterious effects. Said interim ordinance will expire on August 7, 1986, prior to the conclusion of the study and review and the adoption of such permanent zoning regulations; and b. That this City Council has been advised that certain adult businesses are not provided for in the Zoning Code of the City and therefore are not a permitted use in the City, although activities related to operation of such uses are regulated by other chapters of the Municipal Code; and c. That pursuant to Section 65858(a) of the Government Code, notice was given and a public hearing was held on August 11, 1986, and testimony received with respect to the extension of Ordinance No. 1722; and d. That the present structure of the Municipal Code as it relates to such uses could create unnecessary confusion of efforts to reasonably control the location and operation of such uses in the future; and e. That experience related to this type of use in other communities has demonstrated that such uses could have objectionable operations related to the business and unrelated incidents which pose a safety problem, public nuisance and adverse effects on the surrounding community; and f. That because of the nature of such uses it appears that adequate controls are necessary to direct and reasonably control the location and operation of such uses and to insure compatibility of land uses; and g. That the public interest, convenience and neccessity required that a more intensive study be conducted by various Departments making it apparent that an amendment will not be formulated prior to the expiration of the urgency measure and that this Ordinance be immediately adopted for the reasons j above set forth. SECTION 2: That notwithstanding any other provision of the West Covina Municipal Code, during such time as this Ordinance is in full force and effect, no person shall establish or conduct, or permit to be established or conducted, an adult business upon any real property located within the City. SECTION 3: That this ordinance is hereby declared to be an extension of an urgency measure interim ordinance and shall take effect immediately upon its adoption and shall expire ten months and fifteen days after the August 7, 1986, expiration date of Ordinance No. 1722 or upon the effective date of an ordinance adopting the West Covina Municipal Code Amendment No. 198, whichever occurs first. A statement of facts constituting the basis of such urgency is as above set forth. The legal authority for the enactment of this Ordiannce is Section 65858(a) of the Planning Act of the State of California, and other applicable statutes. SECTION 4: The City Clerk shall certify the adoption of this Ordinance and cause the same to be published in the manner prescribed by law.
