ORDINANCE NO. 1712
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF WEST COVINA, CALIFORNIA,
AMENDING ORDINANCE NO, 1674
1. WHEREAS, pursuant to the pr_ovisi.onsof Section,
65858(b) of the Government Code, of the State of California,
the City Council, on April 22, 1985, directed, staff to advertise
an Interim Ordinance relative to Freeway Corridor Study Areas A
and B as shown on Exhibit 1; and'
2. WHEREAS, the City Council on May 28, 1985, adopted
Ordinance No. 1674, declaring a moratorium on Study Areas A and B
as shown on Exhibit 1; and
3. WHEREAS, pursuant to Section 65858(b) of the Govern-
ment Code, Ordinance No. 1674 was adopted as an interim measure
for a period of no longer than 45 days; and
4. WHEREAS, the City Council on July 29, 1985, ex-
tended Ordinance No. 1674 to July 31, 1986, pursuant to Section
65858(b) of the California Government Code and Section 2 of
Ordinance No. 1674; and
5. WHEREAS, pursuant to Section 65854 of the Govern-
ment.Code, after notice and a public hearing, the City Council
may amend Ordinance No. 1674 to provide criteria for the re-
moval of properties from the Freeway Corridor Moratorium and to
consider the removal of the property Located at 2329 West
Garvey Avenue North (Stan Mar:r*Motel.site)from said moratorium
area; and
6. WHEREAS, a notice of a public hearing, pursuant
to Section 65854 of the Government Code, to amend Ordinance No.
1674 was published on December 30, 1985; and
7. WHEREAS, a public hearing was held by the City
Council on January 27t,h 1986.
8. WHEREAS, the City Council b.ereby finds that the
property located at 2329 West Garvey Avenue North (Stan Marr
Motel site) does comply with two or more of the criteria set
by the Council for removal of property from the moratorium
area.
NOW, THEREFORE, the City Council of the City of West
Covina does ordain as follows -
SECTION 1: Ordinance No. 1674 is hereby amended by
the addition of the following:
1. Specific properties may be removed from the
Freeway Corridor Moratorium pursuant to this
ordinance by application to the City showing
that.'.the proposed property for removal com-
plies with two or more of the following cri-
teria:
a. The subject property is part of a larger
site located within a contiguous jurisdic-
tion for which a development elan has been
approved by such jurisdiction prior to the
adoption of Ordinance No. 1674.

b. The proposed use for the subject property
is consistent with the preliminary find-
ings of the Preliminary Freeway Corridor
Study.
C. The subject property is greater than ten
acres in area.
• d. The subject property is owned by a public
agency.
2. The specific property located at 2329 West Garvey
Avenue North, (Stan Marr Motel site) is hereby removed from
the moratorium provisions of this ordinance and the moratorium
area as set forth on Exhibit 1 in that said property complies
with two or more of the removal criteria set forth above.
SECTION 2. The Mayor shall sign and the City Clerk
shall certify to the adoption of this Ordinance and cause the
same to be published in the manner prescribed by law.
