Ordinance - 1708ORDINANCE NO. 1708 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE, CHAPTER 26, ARTICLE XI, SECTION 26-597 AND ARTICLE XII BY ADDING DIVISION NO. 13 AS THEY RELATE TO MOBILE MEDICAL SERVICES TO PERSONS RESIDING IN MULTIPLE -FAMILY FACILITIES (AMENDMENT NO. 201) The City Council of the City of West Covina, California does ordain as follows: SECTION NO. 1: Chapter 26, Article XI, Section 26-597 of the West Covina Municipal Code is hereby amended by adding mobile medical services for persons residing in multiple -family facilities to read as follows: M M M M P R R F F F F 0 N C R S C C M I A P 0 A 1 8 15 20 45 P C C C C 2 3 1 P R B S u u u u u u u u u u u u u u Mobile Medical Services to Persons residing in Multiple -Family Facilities (Article XII, Division 13) SECTION NO. 2: Chapter 26, Article XII of the West Covina Municipal Code is hereby amended by adding division 13 to read as follows: Division 13-Mobile Medical Services Section 26-685.50 Purpose The purpose for this division is to serve the need of the public for convenient and economical medical services to persons residing in multiple -family facilities while guaranteeing the adequacy of the site for the use and the protection of surrounding properties through review and consideration of the periodic on -site placement of a mobile medical unit. Section 26-685.52 Definitions For the purposes of this division, multiple -family facility includes mobile home parks, senior citizen housing projects, apartment complexes, condominium complexes, rest homes and retirement homes. Section 26-685.54-Development Standards a. A mobile medical service shall only be permitted on the site of a multiple -family facility which service shall only be available to persons residing in the multiple family facility. b. An unclassified use permit shall be obtained prior to the operation of a mobile medical service on a multiple -family facility site (as specified in Article VI, Division 3 of this chapter). The application shall include a precise plan (as specified in Article VI, Division 2). C. A mobile medical service company shall be eligible to file an application for an unclassified use permit to operate a mobile medical service on the site of the multiple -family facility only when written authorization is obtained from the owner, his designated and authorized representative or the Home Owners Association of the multipe-family facility. 0 ORDINANCE NO. 1708 d. Location for on -site parking of the mobile unit shall be indicated on the precise plan and shall be so situated that on or off -site traffic shall not be impeded and noise created by the use and its clientele have a minimum impact on the surrounding residences. Section 26-685.86 Conditions of Approval of an Unclassified Use • Permit for Mobile Medical Services to Persons residing in a Multiple -Family Facility. a. Review of the operation permitted by the unclassified use permit is required every six months for an initial two years from the date of commencement of the use and subsequent review, at least once every three years thereafter. b. All residents of the subject multiple -family facility shall be notified of the time and location of the mobile unit operation and shall be eligible to receive the benefit of the service. C. Services rendered by the mobile unit shall be limited to the residents of the subject multiple -family facility. d. The unclassified use permit shall expire 15 days after the owner's, manager's, representative's or Home Owners' Associations's written request to withdraw permission for the permittee to operate a mobile medical service on the subject site has been received by the Planning Director. e. The unclassified use permit may be revoked, amended or suspended by the Planning Commission under the provisions of Section 26-253 of the West Covina Municipal Code. f. Licenses and permits as required in Chapter 14 of the West Covina Municipal Code shall be obtained by the operator of the mobile medical unit prior to the start of the operation of the use. g. Such other conditions as deemed by the Planning Commission to reasonably relate to the purpose of this division. SECTION NO. 3: The City Council finds and determines that said Amendment to the Municipal Code is a minor modification to the City's Zoning Ordinance and is, therefore, categorically exempt (Class 5) from the requirements of the California Environmental Quality Act of 1970 (CEQA) SECTION NO. 4: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
