Ordinance - 1699ORDINANCE NO. 1699 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADDING ARTICLE X TO CHAPTER 20 • OF THE WEST COVINA MUNICIPAL CODE CONCERNING VESTING TENTATIVE MAPS. WHEREAS, the State Legislature has amended the Subdivision Map Act including provisions for Vesting Tentative Maps; and WHEREAS, the Subdivision Map Act requires the City to adopt an ordinance controlling certain elements of the Vesting Tentative Map pro- visions; and WHEREAS, the Subdivision Map Act provisions for Vesting Tentative Maps become effective on January 1, 1986. NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. The attached Arti.cle X of Chapter 20 of the West Covina. Municipal Code is hereby adopted and shall become effective on January 1, 1986. SECTION 2. The City Clerk shall send a certified copy of this ordinance to the Los Angeles County Engineer. SECTION 3. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published as required by law. Added Requirements. Any person requesting approval of a Vesting Tentative Map pursuant to the provisions of the Subdivision Map Act shall comply with and be subject to the applicable provisions of the Subdivision Map .Act and this chapter as it specifi- cally applies to tentative maps and shall also comply with and be subject to the additional provisions of this article. Section 20 - 101. Submittals of Vesting Tentative Maps. In addition to the information and material required by Section 20 - 54., the following submittals are also required prior to approval of a Vesting Tentative Map: 1. Plans for all public works improvements to be constructed as a condition of the subdivision prepared by a Registered Civil Engineer in accordance with City standards and approved by the City Engineer. 2. Plans for all site development including but not limited to grading, drainage facilities and miscellaneous structures pre- pared by a Registered Civil Engineer in accordance with City standards and approved by the City Engineer. Such plans shall be supported by geologic and/or soils engineer's reports as required by Chapter 9 of this Code. 3. Plans for all structures approved by the Building Director. 4. Plans for all irrigation and landscaping approved by the Planning Director. 5. Plot plan showing details of the entire development and all improvements to be constructed in the subdivision. Section 20 - 102. Amendments to Vesting Tentative Maps. After approval or conditional approval of a Vesting Tentative Map, amend- ments can be made only by following procedures for the original approval or conditional approval. Approvals or permits which depart from the Vesting Tenta- tive Map may only be granted based upon an amendment to the Vesting Tentative Map. No amendments shall be granted so as to modify or delete any public improve- ments and site development requirements and condition, including but not limited to grading, drainage facilities and miscellaneous structures, approved in the first instance by the Planning Commission. Section 20 - 103. Application of Fees. The applicable fees associated with the Vesting Tentative Map and the development thereof shall be paid at the then current rate as the various appli- cations, filings, plan checks, permits, etc., are accomplished. • Section.20 - 104. Added Fee for Vesting Tentative Map. In addition to any other fees associated with the Vesting Tentative Map and the development therefor there shall be paid to the City a fee as established from time -to -time by resolution of the City Council to reimburse the City on a pro rata basis for the costs associated with establishing and adopting the proce- dure for Vesting Tentative Maps. Section 20 - 105. Initial Time Period of Rights. The rights conferred by a Vesting Tentative Map shall last for an initial time period of one year beyond the recording of the final map.
