Ordinance - 1695• ORDINANCE NO. 1695 AN ORDINANCE OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA, MUNICIPAL CODE, CHAPTER, 26, ARTICLES XI, SECTION 26-597, AS IT RELATES TO FORTUNE TELLING.(Amendment No. 200) The City Council of the City of West Covina does ordain as follows: SECTION NO. 1: The City Council does hereby find, determine and declare that the following amendment was duly initiated, that notice of hearing thereon was duly given and published, that public hearings hereon were duly held by the Planning Commission and the City Council, and that the public convenience, necessity and general welfare and good zoning practice require that the following amendment be made. SECTION NO. 2: The City Council does hereby find, based on studies and investigations, made by the Planning Commission and in its behalf, of regulations of Office (O-P) and Retail -Commercial (N-C, S-C and R-C) to establish the appropriate zone or zones in which fortune telling as a business use may be located, the following facts: a. Since fortune telling is not a use that produces a product and does require contact with the public, neither manufacturing nor residential zones should be considered as an appropriate zone. b. The nature of fortune telling as a business is not that of a convenient daily shopping facility and is not an appropriate use in the Neighborhood -Commercial (N-C) Zone. C. Office -Professional (0-P), being a less intense zone than N-C, is not an appropriate zone in which to allow fortune telling as a business use. d. Being a service that is more intense than 0-P and N-C type uses, fortune telling as a business land use is an appropriate use to be located in the Service -Commercial (S-C) Zone. e. Being a non -repair type service that is more intense than 0-P and N-C type uses, fortune telling as a business land use is also an appropriate use to be located in the Regional -Commercial (R-C) Zone. f. Offering locations throughout the City the S-C Zone, mainly on North Azusa and Glendora Avenues, and the R-C Zone, in the Eastland Center and central business district areas, this amendment could not be considered to preclude the use due to lack of available sites. SECTION NO. 3: Chapter.26, Article XI, Section 26-597 of the West Covina Municipal Code is hereby amended by adding fortune telling to read as follows: Fortune Telling (Section 15-11) M M M M P R R F F F F 0 N C R S C C M I A P 0 A 1 8 15 20 45 P C C C C 2 3 1 P R B S x x 0 • SECTION NO. 4: The City Council finds and determines that said Amendment to the Municipal Code is a minor modification to the City's Zoning Ordinance and is, therefore, categorically exempt (Class 5) from the requirements of the California Environmental Quality Act of 1970 (CEQA). SECTION NO. 5: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
