AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, ADDING SECTION 2.24
OF DIVISION 1 OF ARTICLE II OF CHAPTER II OF
THE WEST COVINA MUNICIPAL CODE.
• WHEREAS, Government Code Section 1126 provides that a City may
determinethose activities of employees which are inconsistent with, incompatible
to, or in conflict with their duties as City officers or employees; and
WHEREAS, it is determined that the Office of City Councilmember is
incompatible with other positions of employment with the City of West Covina;
and
WHEREAS, election of a City employee to the Office of City
Councilmember may require the Councilmember to become involved in the performance
of an act which may indirectly or directly control, inspect, review, audit,
or enforce his or her actions as an employee of the City;
NOW, THEREFORE, the City Council of the City of West Covina does
ordain as follows:
"SECTION 1. That Section 2.24 be added to Division 1 of Article
II of Chapter II of the West Covina Municipal Code to read as follows:
Section 2-24 - Incompatible Activities. The Office of
City Councilmember and the position of City employee are
hereby determined to be incompatible activities within
the meaning of Government Code Section 1126. Notwithstanding
any other provision in this Code or in the City's Personnel
Rules, a person's employment with the City of West Covina
shall automatically terminate at the time the employee
assumes the Office of City Councilmember."
SECTION 2. The Mayor shall sign and the City Clerk shall certify
to the passage and adoption of this ordinance and shall cause the same to be
published in the manner prescribed by law.
