AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA
AMENDING ARTICLE III OF CHAPTER 5 OF THE WEST COVINA
MUNICIPAL CODE TO AUTHORIZE THE ISSUANCE OF PERMITS FOR
THE PLAYING OF BINGO TO NONPROFIT CHARITABLE ORGANIZATIONS
CONSISTENT WITH PENAL CODE SECTION 326.5•
THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS:
Section 1. Section 5-37 of the West Covina Municipal Code relative to the
• definition of Bingo games is hereby amended to read as follows:
'Sec. 5-37• Definition.
As used in this article, "Bingo'' means a game of chance in which
prizes are awarded on the basis of designated numbers or symbols selected
at random. The game of "Bingo" shall include cards having numbers or
symbols which are concealed and preprinted in a manner providing for distri-
bution of prizes. The winning cards shall not be known prior to the
game by any such person participating in the playing or operation of the
Bingo game. All such pre-printed cards shall bear the legend, "for sale or
use only in a Bingo game authorized under California law and pursuant to
local ordinances."
Section 2. Section 5-41 of Article III'of Chapter 5 of the West Covina
Municipal Code is hereby amended to read as follows:
"Sec. 5-41. Same - Fee.
The application for a Bingo game permit required by this Article
shall be accompanied by a permit fee of an amount established by resolution
of the City Council. If an application for a license is denied, one-half
of the permit fee shall be refunded to the applicant. The permit shall not
be issued until the license collector has verified the facts stated in the
application and has determined that the application meets the requirements
• of this Article.''
Section 3. Section 5-43 of Article III of Chapter 5 of the West Covina
Municipal Code is hereby amended to read at subpart (b) as follows:
'(b) An organization authorized to conduct Bingo games pursuant
to this Article shall conduct a Bingo game only on property owned or
leased by it, or property whose use is donated to the organization
for an office or for performance of the purposes for which the organi-
zation is organized. The permit may be transferred to another location
with the permission of the license collector, if the organization relocates
to another property which it owns or leases, or property whose use is
donated to the organization, for an office or for the performance of the
purposes for which the organization is organized.''
Section 4. The Mayor shall sign and the City Clerk shall certify to the
passage and adoption of this ordinance and shall cause the same to be published
in the manner prescribed by law.
