Ordinance - 1655ORDINANCE NO.1655 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE CHAPTERS 1 AND 12. • WHEREAS, the City. Council of the City of West Covina does find and determine that the periodic collection of garbage and rubbish from all residential premises within the City benefits all the occupants thereof; NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. Section 1-37.1 of the West Covina Municipal Code is hereby amended to add the following: "Chapter 12 - Garbage and Rubbish Collection: Section 12-17." SECTION 2. Section 1-37.2 of the West Covina Municipal Code is hereby amended to delete "Section 12-20 (a), (b), (d)" and to add "Section 12-17, 12-20 (a), (b), (d)." SECTION 3. Section 12-16 of the West Covina Municipal Code is hereby amended to add the following: "Ordinary household garbage: Ordinary household garbage means all animal and vegetable waste that has resulted from the preparation of food. Ordinary household garbage also means all leaves, grass, trash, cuttings, shrubs, combustible waste, and inorganic refuse, both combustible and non-combustible, that accompany routine household or property maintenance functions." .SECTION 4. Section 12-17 of the West Covina Municipal Code is hereby amended to.add the following: "It is the duty of the waste collector, as part of regularly scheduled waste collection, to collect all ordinary household garbage from all residential premises within the City that subscribe for.such service. It shall be the duty of all occupants or persons in possession, charge or control of any residential premises within the City from which ordinary household garbage is created, accumulated or produced, to subscribe to the collection service provided by the City. However, when the residential premises are vacant for at least one month, no collection will be mandatory during the period of vacancy. Further, when the joint or multiple use of garbage containers is provided on the residential premises, it shall be the duty of the person in possession, charge or control of such containers, to subscribe to the City's collection service." SECTION 5. Section 12-21(b)(1) of the West Covina Municipal Code is amended to read: "(1) Single bulky items of solid waste or items not in containers shall be collected provided that no item exceeds three (3) feet in length and one (1) foot in diameter, or weigh over fifty (50) pounds." SECTION 6. Section 12-21(b)(2) of the West Covina Municipal Code F is amended to read: "(2) Solid waste in bundles shall be collected provided that each bundle is tied and does not exceed three (3) feet in length and one (1) foot in diameter, or weigh over fifty (50) pounds." SECTION 7. That the Mayor shall sign and the City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. • 0 Passed and approved this loth day of nerember 1984.
