Ordinance - 1651ORDINANCE NO. 1651 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST • COVINA, CALIFORNIA, AMENDING SECTION 26-204 OF THE WEST COVINA MUNICIPAL CODE RELATING TO PARK FEES IN CONNECTION WITH MULTIPLE FAMILY RESIDENTIAL DEVELOPMENT. WHEREAS, the City Council on October 13, 1970, adopted Ordinance No. 1144 establishing Park Fees to be applied with multiple family residential develop- ment;- and WHEREAS, said ordinance specified dollar amounts of the fees to be applied and such amounts have not been periodically adjusted to maintain an approximate relationship to the cost of providing park and recreational facili- ties; and WHEREAS, said originally established Park Fees were equivalent to the similar fees applied to subdi.visi-ons and the manner of applying subdivision fees has since been. amended on February 28, 1983, as required by revisions to the State Map Act; and WHEREAS, the City Council desires that the Park Fees in connection with multiple family residential development bear an approximate relationship to the cost of provi.din.g park and recreational facilities and be equivalent to those similar fees applied to subdivisions. • NOW, THEREFORE, the City Council of the City of West Covina does hereby ordain. as follows: SECTION 1. Section 26-204 of the West Covina Municipal Code is amended to read as follows: Section 26-204. Park Fees. (a) Every person who constructs a multiple family residential development shall pay a fee as set forth in Section 20-40 for the purpose of providing park and recreational facilities to serve future residents of such development. (b) The Planning Commission may, as a condition to the approval of any precise plan of design and/or unclassified use permit for a multiple family residential development, waive or reduce the requirement of the preceding paragraph for the payment of fees for park or recreation purposes wherever it is reasonable to do so in view of its studies and investigations and in consideration of the circumstances. (c) This section shall apply to all undeveloped multiple family residential property and to all approved precise plans and/or unclassified use permits which have not commenced construc- tion prior to the effective date of this section. • SECTION 2. That the City Clerk shall certify to the passage of this ordinance and shall cause the same to be published.
