AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, ADDING
DIVISION 6 TO ARTICLE III, CHAPTER 2
OF THE MUNICIPAL CODE CREATING THE
TRANSITION/WASTE MANAGEMENT COMMISSION

The City Council of the City of West Covina, California,
does ordain as follows:
SECTION NO. 1: Division 6 is hereby added to Article III,
Chapter 2 of the Municipal Code to read as follows:
DIVISION 6. TRANSITION/WASTE MANAGEMENT
COMMISSION
Section 2-126 Created; Composition
The Transition/Waste Management Commission is hereby created. The
Transition/Waste Management Commission shall consist of seven (7)
members, all of whom shall be residents of the city and appointed by
the City Council.
Section 2-127 Terms of Office and Removal
The members of the Transition/Waste Management Commission shall be
appointed by resolution of the City Council for staggered two-year
terms ending on June 30. Each member shall hold office after the
expiration of his term until his successor is appointed and quali-
fied. All members shall serve at the pleasure of the City Council
• and may be removed from office by the City Council at any time
during the term for which the member was appointed.
Section 2-128 Vacancies
Vacancies in the Transition/Waste Management Commission occurring
otherwise than by expiration of the term shall be filled for the
unexpired term of the Commissioner by the City Council.
Section 2-129 Organization
The Transition/Waste Management Commission, at its first regular
meeting each July, shall elect a chairperson and a vice -chairperson
from among its members, both of whom shall serve one-year terms.
The Secretary to the Commission shall be the Community Services
Division Manager or his designate. The Commission shall have the
power to adopt rules for the transaction of business and shall keep
a record of resolutions, findings and determinations.
Section 2-130 Meetings
The Transition/Waste Management Commission shall hold regular
monthly meetings except in those months when the B.K.K. Landfill
Hazardous Waste Disposal Transition Task Force meeting is conducted.
The Commission shall determine, by resolution, the manner in which
such meetings shall be organized and conducted and the day(s) of the
month on which the meetings will be held. The time and place of
said meetings shall be as provided for by resolution adopted by the
City Council. A majority of -the members of the Commission shall
constitute a quorum for the transaction of business. All meetings,
including special meetings, shall be held in the manner provided for
in the Ralph M. Brown Act, Section 54950 et. seq, of the California
Government Code.
Section 2-131 Compensation
Compensation for members of the Transition/Waste.Management Commis-
sion shall be set by resolution of the City Council.
Section 2-132 Duties and powers
• The Commission shall:
a. Act in an advisory capacity to the City Council on matters
pertaining to the management of hazardous and non -hazardous
wastes including the transition from the land disposal of
hazardous wastes and other waste management matters which
will improve the protection of the public's health and the
environment.
b. Appoint three (3) of its members to sit with and conduct
quarterly meetings of the Transition Task Force as it is
currently constituted to facilitate transition from the land
disposal of hazardous waste and maintain liaison with the
responsible agencies that deal with aspects of the waste
management issue. The terms of these appointments shall be
determined by the Commission.
C. Investigate or cause to be investigated, and recommend to
the City Council the development of State legislation that
would facilitate transition, improve the management of haz-
ardous and non -hazardous wastes and otherwise improve the
protection of the public's health and the environment. In
this connection, the Commission shall attempt to secure
sponsors and to testify on behalf of proposed legislation
which has been considered and approved by the City Council.
• d. Conduct meetings with individuals, groups and organizations
to establish and maintain an open dialogue for input and
discussions of waste management issues in an effort to
secure support for the improvement of the existing waste
management system.
e. Act on any other matters assigned to the Commission by the
City Council.
SECTION NO. 2: The City Clerk shall certify to the pas-
sage of this Ordinance and shall cause the same to be published as
required by law.
