AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, EXTENDING AN INTERIM
ORDINANCE RELATING TO SENIOR CITIZEN HOUSING DEVELOP-
MENT ON PROPERTY WITHIN ALL ZONES FOR A PERIOD OF TEN
(10) MONTHS AND FIFTEEN (15) DAYS. (Urgency Measure)
The City Council of the City of West Covina does ordain as follows:
SECTION 1: That the City Council of the City of West Covina does
hereby find, determine and declare as follows:
a. That an initial Interim Ordinance No. 1588, was adopted on May 9, 1983,
and will expire on June 23, 1983, prior to the conclusion of the study
and review and the adoption of such permanent zoning regulations; and
b. That a subsequent Ordinance extending Interim Ordinance No. 1588 is
necessary to allow a sufficient period of time to make a complete study
and review as to the precise nature of permanent zoning regulations to
be imposed in connection to Senior Citizen Housing Development; and
C. That this City Council has been advised of recent inquiries and pending
proposals to develop senior citizen housing projects at densities above
twenty (20) units per acre for both non -low-income and low-income senior
citizens, with waivers from development standards for such projects; and
d. That the Municipal Code does not presently provide for non -governmental
affordable housing projects and poses a threat to the general welfare
of senior citizen residents seeking to reside in decent, safe and
affordable housing; and
e. That the Municipal Code does not define "affordable" nor cbes it_&si4nate and
• regulate waivers from development standards for senior citizen projects
and the possibility of poorly designed complexes creating a deleterious
affect on residents and the community poses a threat to health and
safety; and
f.. That the public interest, convenience and neccessity require that this
Ordinance be adopted for that set forth above.
SECTION 2: That notwithstanding any other provision of the West Covina
Municipal Code, during such time.as this Ordinance is in full force and effect, no
person shall establish, or permit to be established upon any real property located
within the City, any senior citizen development, such as but not limited to, apart-
ment housing, condominiums or other such housing provided exclusively for senior
citizen residents whether the services or facilities are provided for profit or not
for profit, with or without charge.
SECTION 3: That this Ordinance is hereby declared to be a first and
initial extension of an urgency measure ordinance and shall take effect immediately
upon its adoption and shall expire ten (10) months and fifteen (15) days after the
June 23, 1983, expiration date of Ordinance No. 1588, or upon the effective date of
an ordinance adopting the West Covina Municipal Code Amendment No. 184, whichever
occurs first. A statement of facts constituting the basis of such urgency is as
set forth above., The legal authority for the enactment of this Ordinance is Section
65858 of the Planning Act of the State of California, and other applicable statutes.
•- SECTION 4: The City Clerk shall certify. the adoption of this Ordinance
and cause the same to be published in the manner prescribed by law.
