AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, RELATING TO SENIOR CITIZEN HOUSING DEVELOPMENT ON
PROPERTY IN ALL ZONES. (Urgency Measure)
The City Council of the City of West Covina does ordain as follows:
• SECTION 1: That the City Council of the City of West Covina does hereby
find, determine and declare as follows:
a. That there have been recent inquiries and proposals to develop senior
citizen housing projects at densities above 20 units per acre for both
non -low-income and low-income senior citizens, with waivers from
development standards for the latter; and
b. That the Municipal Code does not define terms such as "senior citizen"
and "low-income" nor does it adequately provide for the development
and operation of senior citizen housing which is not under direct
federal goverment supervision; and
c. That there is currently no vacant land in the City of West Covina
that is zoned for or designated on the General Plan for more than 20
units per acre; and
d. That this ordinance is immediately required to permit sufficient time
as would be reasonably necessary for the City's Zoning Department and
Planning Commission to make a complete study and review as to current
City policy and Code regulations and the capacity to provide for and
address the variety of senior citizen housing proposals; and
e. That such interim measure will enable the City to develop Code regu-
lations -necessary to provide for pending proposals and safeguard against
• deleterious affects on the community that may be created by improperly
designed developments; and

f. That the public interest, convenience and necessity require that this
Ordinance be immediately adopted for that set forth above.
SECTION 2: That notwithstanding any other provision of the West Covina
Municipal Code, during such time as this Ordinance is in full force and effect, no
person shall establish, or permit to be established upon any real property located
within the City, any senior citizen development, such as but.not limited to, apartment
housing, condominiums or other such housing provided.exclusively for senior citizen
residents whether the services or facilities are provided for profit or not for profit,
with or without charge.
SECTION 3: That this Ordinance is hereby declared to be an urgency measure
and shall take effect immediately upon its adoption for a initial study period of
45 days from date.of adoption. A statement of facts constituting the basis of such
urgency is as above set forth. The legal authority for enactment of this Ordinance
is Section 65858 of the Planning Act of the State of California, and other applicable
statutes.
SECTION 4: The City Clerk shall certify the adoption of this Ordinance
and cause the same to be published in the manner prescribed by law.
