AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA AMENDING THE MUNICIPAL CODE CHAPTER
• 26 BY REVISING SECTION 26-391(h) AND SECTION
26-438 RELATING TO THE PROHIBITED PARKING OR
STORING OF COMMERCIAL VEHICLES ON RESIDENTIAL
PROPERTY.

THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION ONE. The West Covina Municipal Code is hereby amended
by revising subsection (h) of Section 26-391 "Permitted Uses" to
read as follows:
(h) Parking or storing of commercial vehicles is
prohibited. It shall be unlawful to park or store on
property that is zoned for R-A or R-1 residential use
any commercial vehicle that is a motor truck, a truck
tractor, a trailer, a semi -trailer or any combination
thereof and that has a manufacturer's gross vehicle
weight rating of 10,000 pounds or more. For the
purposes of this Section, the terms commercial vehicle,
motor truck, truck tractor, trailer and semi -trailer
shall have the meaninas ascribed to them in Section 22-1
of this code.
SECTION TWO. The West Covina Municipal Code is hereby amended
by revising Section 26-438 "Parking or Storing of Commercial Vehicles"
to read as follows:
Sec. 26-438 Parking or storing of commercial
Vehicles.
It shall be unlawful to park or store on property
that is zoned for multiple -family residential use any
commercial vehicle that is a motor truck, a truck tractor,
a trailer, a semi -trailer, or any combination thereof and
that has a manufacturer's gross vehicle weight rating of
10,000 pounds or more. For the purposes of this Section,
the terms commercial vehicle, motor truck, truck tractor,
trailer, and semi -trailer shall have the meanings ascribed
to them in Section 22-1 of this code.
SECTION THREE. If any section, subsection, sentence, clause,
phrase, part or portion of this Ordinance is for any reason held to
be invalid or unconstitutional by any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council declares that it would have
adopted this Ordinance and each section, subsection, sentence, clause,
phrase, part of portion thereof, irrespective of the fact that any or
one or more sections, subsections, clauses, phrases, parts or por-
tions be declared invalid or unconstitutional.

SECTION FOUR. The Mayor shall sign and City Clerk shall
certify to the passage and adoption of this Ordinance and shall
cause the same to be published in the manner prescribed by law.
