CODE OF THE CITY OF WEST COVINA, CHAPTER 26,
ARTICLES II AND X, AS THEY RELATE TO NON-RESI-
DENTIAL OFF-STREET PARKING IN SHOPPING CENTERS
(Amendment No. 178).
The City Council of the City of West Covina does .ordain.
as follows:
SECTION 1 Chapter 26, Article II, is hereby amended by
adding the following Section to read as follows:
Definitions - Section 26.103.5
"Specialized non-residential use" shall include those uses which
require an unclassified use permit in order to operate in a commercial
zone and shall also include the following uses when such uses are pro-
posed to be established in an existing, planned or proposed commercial
center:
1. Restaurants with greater than 2,500 square feet of gross floor area.
2. Theaters
3. Bowling alleys
4. Any other office or commercial use which requires a parking ratio
greater than one space per 250 square feet of gross floor area.

amended by arcing the following Section to read as follows:
Section 26-582
(P) Shopping Center and Planned Center Uses In Non-residential Zones:
1. One space for every 250 square feet of primary building area;
except that one space for every 100 square feet of unidentified
building pads or identified restaurant pads, with undetermined
seating capacity, attached or detached to the primary building
area will be,required additional parking as necessary for
individual specialized non-residential uses proposed or antici-
pated for the center will be required according to this Section
and Article 12 of this Chapter.
2. No specialized non-residential use shall be permitted to be
established or operate within existing shopping centers or
centers with approved precise plans until.an unclas-
sified use permit is first obtained and it has been determined
if adequate parking exist to accommodate the specialized use.
3. Total parking requirements of all uses shall be calculated for
a precise plan or center in which a specialized non-residential
use is proposed to be established. Under the provisions of
Section 26-581(f) of this Chapter, calculated parking required
for general retail uses may be reduced by 15 percent if
approved by the Planning Commission. Parking required for
specialized commercial uses shall not be reduced under Section
26-581(f). Total parking required for general retail uses and
specialized commercial uses shall not exceed the amount of
parking provided within an existing center or approved center.

SECTION 3: The City Council finds and determines that
said amendment to the Municipal Code is a minor modification to the
City's Zoning Ordinance and is, therefore, Categorically Exempt
(Class 5) from the requirements of the California Environmental
Quality Act of 1970 (CEQA).
SECTION 4: The City Clerk shall certify to the passage of
this ordinance and shall cause same to be published as required by
law.
