Ordinance - 1561ORDINANCE NO. 1561 r� U • • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY.OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE, CHAPTER 26, ARTICLE XI AND XII AS THEY RELATE TO GYMNASIUMS AND ATHLETIC CLUBS IN RESIDENTIAL AND NONRESIDENTIAL ZONES. (Amendment No. 176) The City Council of the City of West Covina does ordain as follows: SECTION 1: Chapter 26, Article XI, Section 26-597 of the West Covina Municipal Code is hereby amended by amending gymnasiums and athletic clubs to read as follows: Athletic Clubs (Section 26-685.20) Gymnasiums (Section 26-685.20) M M M M P R R F F F F O N C R S C C M I A P 0 A l 8 15 20 45 P C C C C 2 3 1 P R B S u u u u u u u u u u u u u u u u u SECTION 2: Chapter 26, Article XII.of the Municipal Code is hereby amended by adding Division 11 to read as follows: Division 11 7Gvmnasiums and Athletic Clubs Section 26 - 685.20 Purpose The purpose of this division is to serve the need of the public in regard to gymnasiums and athletic clubs while guaranteeing the adequacy of the site for the use and the protection of the surrounding pro- perties through consideration of physical treatment, parking require- ments and compatibility with surrounding properties. Section 26 - 685.22 Definitions a. Athletic Club: A site containing two or more indoor or outdoor facilities such as gymnasiums, racketball courts, and swimming pools, which devotes less than ten percent of its.building floor area to massage or bathhouse activities (also called health spa). b. Gymnasium: A room or building equipped for physical training, sports or exercise that may include accessories such as locker rooms and showers. Section 26 - 685.24 Prohibitions Outdoor activities are prohibited for athletic clubs located in the civic center overlay zone. Section 26 - 685.26 Development Standards and Conditions a. Gymnasiums and athletic clubs may be established only in the zones as specified in Section 26-597. b. An unclassified use permit shall be obtained prior to establishing a gymnasium or athletic club (as specified in Article VI, Division 3 of this Chapter). The application shall include a precise plan (as specified in Article VI, Division 2). C. The development standards of the zone in which this use is to be located shall apply (as specified in Article X, Division 3 of this Chapter) unless this Section specifically permits or prohibits otherwise. d. Specific development requirements: Parking required: 1. The minimum parking requirement for a gymnasium or athletic club shall be one parking space for each 100 square feet of gross floor area (see definition). 2.. The number of required parking spaces may be increased based • on studies and investigations made by or for the Planning Commission to an amount deemed reasonable by the Planning Commission. 3. In no case shall the parking provided for a gymnasium or athletic club be less than that stated in Subsection (1) of this Section, 26-685.26 (d). 4. Gymnasiums and athletic clubs are both day and nighttime uses and are not eligible for joint use parking requirement reductions stated in Section 26-581(e). 5. Total parking requirements of all the uses shall be calculated for a precise plan or shopping center in which a gymnasium or athletic club is proposed to be established. Under the pro- visions of Section 26-581(f) of the Municipal Code, general retail use parking requirements may be reduced by 15 percent if approved by the Planning Commission. Restaurant parking requirements shall not be reduced under the provisions of Section 26-581(f). The total parking requirements of general retail uses (reduced by 15 percent if approved by the Planning Commission), restaurants and the gymnasium or athletic club shall not exceed the amount of the parking provided for in the shopping center or precise plan. • e. Conditions of approval of an unclassified use permit for gymnasiums and athletic clubs: 1. Review of the operation permitted by the unclassified use permit is required every six months for a period of two (2) years, beginning on the date of the start of operation of the use. 2. The unclassified use permit shall become null and void upon transfer of ownership or any other interest in the use permitted. 3. The unclassified use permit may be revoked, amended and suspended by the Planninq Commission under the provisions of Section 26-253 of the West Covina Municipal Code. 4. Licenses and permits as required in Chapter 14 of the West Covina Municipal Code shall be obtained prior to the start of the operation of the use. 5. Such other conditions as deemed by the Planning Commission to reasonably relate to the purpose of this Division. .7 • SECTION 3: The City Council.finds and determines that.said amendment to the Municipal Code is a minor modification to. the City's Zoning Ordinance and is, therefore, categorically exempt (Class 5) from the requirements of the California Environmental Quality Act of 1970 (CEQA) . SECTION 4: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. PASSED and APPROVED this 25th day of October , 1982.
