Ordinance - 1555ORDINANCE NO. 1555 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING • SECTION 1704 OF THE UNIFORM BUILDING CODE, 1979 EDITION, BY THE ADDITION OF NEW SECTION 7-18.12 TO CHAPTER 7 OF THE WEST COVINA MUNICIPAL CODE RELATING TO ROOFS WHEREAS, Health and Safety Code Section 17958.5 provides for a city to make changes or modifications in the Uniform Building Code, 1979 Edition, as are reasonably necessary because of local climatic, geographical, or topogranhical conditions; and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modi- fiactions.in the Uniform Building Code before adopting such changes; and WHEREAS, the City Council desires to amend Section 1704 of the Uniform Building Code, 1979 Edition, as heretofore adopted by the City Council of the City of West Covina, for the reasons hereinafter set forth. THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: • SECTION ONE. Chapter 7 of the West Covina Municipal Code is hereby amended by the addition thereto of a new Section 7-18.12 which shall read as follows: (a) Notwithstanding any other provision of the Building Code and Appendix to the contrary, the roof covering of any building hereinafter constructed, regardless of type of Occupancy Classification, shall be of noncombustible or fire -retardant construction as defined in Section 3203 (e), items 1, 2, 3, 4, 6, 7, 8, 9, 10 and 11 of the Uniform Building Code. (b) Any replacement or repair that consists of more than 25% of the total area of an existing roof within a 12-month period must be made in conformance with Subsection (a) herein. Room additions must also comply with said subsection (a). Skylights shall be constructed as required in Chapter 34 of the Uniform Building Code. Penthouses shall be constructed as required in Chapter 36 of the Uniform Building Code. Any use of plastics in roofs shall be in accordance with the provisions of Chapter 52. Any construction relating to attics shall be in accordance with those governed by the provisions of Section 3205 of the Uniform Building Code. The.pro- visions of Section 3207 of the Uniform Building Code shall govern roof drainage. - 1 - SECTION TWO. The City Council of the City of West Covina hereby determines that the amendment to Section 1704 of the Uniform Building Code, 1979 Edition, is expressly found to be reasonably necessary for the health, safety and general welfare of the residents of the City of West Covina due to the following climatic, geographical and topographical conditions: (a) That late summer and fall seasonal climatic conditions create numerous serious difficulties to the control and protection against fire situations in the City of West Covina. The hot, dry weather in combination with Santa Ana winds result in wildland fires in the brush covered slopes in the San Jose Hills area, as well as other brush areas. When fire occurs in such areas, particularly during the summer and fall, the entirety of local fire department personnel is required to control, monitor, fight and protect against such fire situations in an effort to protect life and preserve property and watershed land. The same climatic conditions may result in the concurrent occurrence of one or more fires, which then may become contagious, in the more populated areas of the City without adequate fire department personnel to protect against and control such a situation. Further the effect of Santa Ana winds and extremely dry weather upon the dry wood roofs and roofs made of minimal fire resistance material create an extremely uncontrollable and contagious situation substantially endangering life and property. Therefore, the above described factual findings support the imposition of fire protection require- ments greater than those set forth in the State Building Standards Code, as adopted by the City of West Covina and • set forth in Chapter 7 of the West Covina Municipal Code and in particular, support the imposition of Section 1704 of Section .`7-18.12 of the aforementioned proposed ordinance. (b) Many residential neighborhoods, and many commercial areas consist of structures of limited fire resistance capability. The City contains large areas of unimproved and improved brush covered acreage and also has thousands of street trees and shrubbery. The above described factual findings demonstrate the grave potential for a fire of an uncontrollable and contagious nature spreading throughout large parts or all of the City substantially endangering life and property. Therefore the above described factual findings support the imposition of fire protection requirements greater than those set forth in the State Building Standards Code, as adopted by the City of West Covina and set forth in Chapter 7 of the West Covina Municipal Code, and in particular, support the imposition of Section 1704 of Section 7-18.12 of the aforementioned proposed ordinance. SECTION THREE. The City Council further determines that the State Building Code, as adopted by the City of West Covina and set forth in Chapter 7 of the West Covina Municipal Code, should be modified, changed and amended as provided for herein based upon the foregoing findings, and that the said City • Council takes the aforedescribed action because of the public interest in protecting life and preserving public safety and property. -2- a SECTION FOUR.
