AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL
CODE BY REPEALING CHAPTER 4 (Aircraft) AND AMENDING
CHAPTER 26, ARTICLES II, XI AND XII TO PROVIDE A
DEFINITION FOR AIRCRAFT AND SET PROVISIONS FOR REVIEW-
ING AND APPROVING TEMPORARY AND PERMANENT AVIATION LAND
USES WITHIN THE CITY. (Amendment No. 172)
The City Council of.the City of West Covina does ordain
as follows:
SECTION I: Chapter 4 is hereby repealed from the West Covina
Municipal Code.
SECTION 2: Section 26-18.5 is hereby added to the West Covina
Municipal Code and will read as follows:
Section 26-18.5 - AIRCRAFT
A device that is used or intended to be used for flight in the air
including, but not limited to, hang gliders, motorized hang gliders,
ultralights, hot-air balloons, planes and helicopters4. except.as _
provided. for in !-Section.:.26.=339 of. ;thi Chapter:. .
SECTION 3: Section 26-611 is hereby added to the West Covina
Municipal Code and will read as follows:
ection 26-611 SAME - AIRCRAFT TAKEOFF AND LANDING
a. The temporary takeoff or landing of any aircraft, airplane, or heli-
copter may be permitted from property within any zone (residentially
zoned property must lb'e vacant, of sufficie nt size, a nd located so as
rot to be detrimental or a danger to existing residential developments) ,
only after written permit is granted by a majority vote of the tempor-
ary use permit committee for a period not to exceed five (5) conse-
cutive days or fifteen (15) .calendar days a year..
b. A temporary use permit shall not be granted for any temporary use
involving a powered aircraft, airplane, or helicopter within one
thousand feet of any public or private schools (Grades K - 12) .
c. Aircraft activity subject to temporary use permit requirements shall
not include carnival rides involving helicopters, tethered hot-air
balloons or other aircraft.
d. The landing or liftoff of any manned hot-air balloon used for unteth-
ered flight is prohibited on property within the City.
e'. Application for such use shall also include a location map designating
the la ndi ng area, significant structures within the surrounding area,,
land uses within three hundred (300) feet of the landing site and pro-
posed approach and departure routes.

SECTION 4: Division 7, Section 26-683 is hereby added to the
Covina.Municipal Code and will read as follows:
Division 7. - AIRCRAFT LANDING FACILITIES
Section 26-683
A. purpose
The purpose of this Section is to provide for the development of non-'
emergency aircraft landing facilities and to set evaluation criteria
and operating regulations that will prevent any undue burden, hardship
or danger to the surrounding community from the services or activities
of such a facility.
B. Regulation
Any site, location or facility,used for non -emergency aviation activity
involving aircraft shall be considered a non -emergency aircraft facility
and subject tothe criteria and regulations of this division, in
addition to any special conditions imposed by an unclassified use permit.
A takeoff and landing area permanently designated for the sole purpose
of receiving and dispatching aircraft designed specifically for emer-
gency relief services 'or other public safety emergency needs, or the
transport of accident victims for emergency treatment shall be consid-
ered an emergency facility and subject only to approvals as required
by State and Federal agencies regulating aviation activity.
C . � Development Standards
1. An unclassified use permit shall be obtained prior to the devel-
opment of a non -emergency landing facility (as specified in Article
VI, Division 3 of this Chapter). The application for such permit
shall also include as follows:
a. A noise test taken by applicant between the hours of 7:00 a.m.
and 8:00 p.m. at the residential properties most likely to
be affected by the landing site and approach/departure routes.
Test is to include three measured readings from simulated
landings of the actual type of aircraft using the landing site.
b. A location map designating the landing site, any significant
structures within the vicinity, land uses within 300 feet of
subject property and proposed approach and departure routes.
2. Development of the landing facility shall comply with all the
• design standards and regulations set by the Federal Aviation
Administration, State Department of -Transportation and any other
agency having approval authority over such a facility.
3. No aircraft landing faci.`lity shall permit the landing or liftoff
of a manned hot-air balloon used for untethered flight.
4. The Planning Commission may make modifications and attach condi-
tions to the proposed operation of any landing facility application
as it feels is necessary to insure compatibility of land uses with
surrounding development and protect surrounding residential devel-
opments from adverse noise impacts.
SECTION 5: Section 26-597 is hereby amended to the West Covina
Municipal Code and will read as follows:

SECTION 6: The City Council finds and determines that said
amendment to the Municipal Code is a minor modification to the City's
Zoning Ordinance and is, therefore, categorically exempt (Class 5) from
the requirements of the California Environmental Quality Act of 1970. (CEQA).
SECTION 7: The City Clerk 'shall certify to the passage of this
