Ordinance - 1533ORDINANCE NO 1533 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, RELATING TO MASSAGE PARLORS ON PROPERTY WITHIN ALL ZONES. (URGENCY MEASURE) The City Council of the City of West Covina does ordain as follows: SECTION 1. That the City Council of the City of West Covina does hereby find, determine and declare as follows: (a) That this City Council'has been advised that certain businesses such as massage parlors are no.t provided for in the Zoning Code of the City and therefore are not a permitted use in the City, although activities related to operation of such uses is regulated by other chapters of the Municipal Code; and (b) That the present structure of the Municipal Code as it relates to such uses could create unnecessary confusion of efforts to reasonably control the location and operation of such uses in the future; and (c) That experience related to this type of use in other communities has demonstrated that such a use could have objectionable operations related to the business and unrelated incidents which pose a safety problem, public nuisance and adverse affects on the surrounding community; and (d) That because of the nature of such uses it appears that adequate controls are necessary to direct and reasonably control the location and operation of such uses and to insure compatibility of land uses; and (e) This Ordinance is immediately required to permit sufficient period of time as would be reasonably necessary for the City's Zoning Department and Planning Commission to make a complete study and review as to the precise nature of permanent zoning regulations to be imposed in order to protect existing commercial and residential areas in the City, from adverse downgrading_ and deleter- ious affects; and (f) That the public interest, convenience and necessity require that this Ordinance be immediately adopted for the reasons above set forth. SECTION 2. That notwithstanding any other provision of the West Covina Code, during such time as this Ordinance is in full force and effect, no person shall establish or conduct, or permit to be established or conducted, upon any real property located within the City, any businesses upon the premises of which massage activities are permitted or conducted, whether for profit or not for profit, whether the services are provided with or without charge. That this Ordinance is hereby declared to be an urgency measure and shall take effect immediately upon its adoption for an initial study period of four (4) months from the date of adoption. A statement of facts constituting the basis of such urgency is as above set forth. The legal authority for the enactment of this Ordinance is Section 65858 of the Planning Act of the State of California, and other applicable statutes. SECTION 4. The City Clerk shall certify the adoption of this Ordinance and cause the same to be published in the manner prescribed by law. PASSED and APPROVED this 22nd day of February 1982.
