• AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA AMENDING THE WEST
COVINA MUNICIPAL CODE BY REVISING AND
REPEALING CERTAIN SECTIONS THEREOF WHICH
HAVE BEEN PREEMPTED BY STATE STATUTE
WHEREAS, from time to time, general ordinances of
the City have been adopted and codified in the West Covina
Municipal Code; and
WHEREAS, certain of these general ordinances have
been preempted by state statute since their adoption and
codification; and
WHEREAS, general ordinances of the City that have
been preempted by state statute are void; and
WHEREAS, the City Council desires to maintain the
West Covina Municipal Code in conformance with state statute
by revising or repealing those ordinances that have been
preempted;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
. WEST COVINA DOES ORDAIN AS FOLLOWS:
Section One. The West Covina Municipal Code is
hereby amended by revising Section 6-8 to read as follows:
Sec. 6-8. Enforcement by authorized personnel.
The Chief of Police or any of his officers, the
Pound Master or any of his deputies and the City Health
Officer. or any member or employee of the Health Department
are hereby empowered to enforce all of the provisions of
this chapter.
Section Two. The West Covina Municipal Code is
hereby amended by repealing the following Sections.
Sec. 15-4. "Drunkenness".
Sec. 15-5. "Consuming alcoholic beverages in
public places".
Sec. 15-6. "Inhaling or drinking certain substances".
Sec. 15-30. "Providing minors with firearms
unlawful".
• Sec. 15-62 through Sec. 15-71, inclusive.
"Registration of Felons".
Sec. 22-99. "Riding on motorcycles and bicycles".
Sec. 22-100. "Clinging to moving vehicle".
Sec. 22-101. "Operation of vehicles on private
property open to public".
Section Three. If any section, subsection,
sentence, clause, phrase, part or portion of this Ordinance
is for any reason held to be invalid or unconstitutional by
any court of competent jurisdiction, such decision shall not
• affect the validity of the remaining portions of this
Ordinance. The City Council declares that it would have
adopted this Ordinance and each section, subsection, sen-
tence, clause, phrase, part or portion thereof, irrespective
of the fact that any one or more sections, subsections,
clauses, phrases, parts or portions be declared invalid
or unconstitutional.
Section Four. The Mayor shall sign and City Clerk
shall certify to the passage and adoption of this ordinance
and shall cause the same to be published in the manner
prescribed by law.
