Ordinance - 1507ORDINANCE NO. Prb 7 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF -WEST COVINA. ADDING ARTICLE VII TO CHAPTER 15 OF THE WEST-COVINA MUNICIPAL CODE RELATING TO THE DISPOSAL OF HAZARDOUS WASTES FROM ABANDONED DUMPSITES (EMERGENCY ORDINANCE) WHEREAS the State of'California has embarked on a ° program to clean up abandoned dumpsites which contain hazardous waste; and WHEREAS an estimated 100 to 150 such abandoned sites exist in the Southern California.area; and WHEREAS`a program to clean up an abandoned dump site in Southern California known as "McCall Site" is presently before the State Legislature; and WHEREAS the State has failed to establish adequate disposal sites for disposal of such hazardous wastes from aban- doned dump sites; and WHEREAS it appears that unless the State immediately establishes and provides for adequate landfill sites to handle the disposal of such hazardous wastes that the BKK Sanitary Landfill in the City of West Covina will become the receiver of large quanti- ties of these hazardous wastes emanating from abandoned dump sites; and • WHEREAS it is inequitable for the City of West Covina to bear the burden of receiving hazardous wastes from all the aban- doned dump sites in the whole of Southern California; and WHEREAS the citizens of the City of West Covina have expressed strong concern and objections over such hazardous wastes being transported to and disposed of in the City of West Covina, NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. Chapter 15 of the West Covina Municipal Code is hereby amended by the addition thereto.of a new Article VII to read as follows: ARTICLE VII DISPOSAL OF HAZARDOUS WASTES FROM ABANDONED DUMP SITES Section 15-150. Disposal of Hazardous Wastes from Abandoned . Sites Prohibited. Hazardous. waste, as defined in the State Hazardous Waste Control Act and the regulations adopted pursuant thereto, originating from any abandoned dump site or any other disposal site not presently authorized to receive said hazardous waste, shall not be disposed of, at, or in any sanitary landfill within the City of West Covina. SECTION 2. This ordinance is passed and adopted by a four -fifths (4/5) vote of the City Council as an emergency ordi- nance, pursuant�to. the provisions of Government Code 36937, for the immediate preservation of the=public..peace, health, or safety in that the transportation and disposal of large quantities of hazardous wastes from abandoned dump sites presents serious poten- tial health threats to the citizens of West Covina since hazardous wastes transferred from abandoned dump sites may contain unidenti- fied chemicals which alone or in combination may be injurious to the health and safety of the citizens and that further the trans- fer of large quantities of hazardous materials from abandoned dump sites to the.EKK Landfill site in the City will require increased truck loads .of hazardous waste materials.on and over the streets of the City, thus creating a greater potential safety hazard and increased likelihood of spills of hazardous waste, and that further the technology for the disposal of large quantities of hazardous waste from abandoned dump sites in urban areas is insufficient to insure no adverse health effects on the .citizens of West Covina. SECTION 3. If any section, subsection, sentence, clause, phrase, or word of this ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed and adopted this ordinance and each and all provisions there- of irrespective of the fact that any one or more of such provisions be declared invalid. SECTION 4. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published • as required by law. Passed and approved this 27 day of April, 1981.
