• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA
MUNICIPAL CODE BY AMENDING CHAPTER. 26, ARTICLE XI,
SECTIONS 26-609, 26-339, 26-304 AND 26-307 RELATING
TO TETHERED BALLOONS AND PROMOTIONAL EVENTS.
(Amendment No. 163)
The City Council of the City of Nest Covina does ordain as
follows:
SECTION l: Section 26-609 of the West Covina Municipal Code
is hereby amended to read as follows:
Section 26-609. Same -- Promotional event;
shopping center/department store.
The outdoor display and sale of merchandise and temp-
orary signs relating thereto during special promotional
events may be permitted for the use of any shoppinq
center or department store for a period of not to
exceed six (6) consecutive shopping days during any
calendar year, such activity to be conducted wholly on
• private property.
SECTION 2: Section 26-339 of the -West Covina.Municipal Code
is hereby amended to read as follows:
Section 26-339. Banners.and pennants
(a) Except in P-B, 0-S, O-P or I-P zones, banners
and pennants without wording and tethered balloons
erected for the purpose of advertising the original
opening of a business may be permitted by the build-
ing department, with a service charge of six dollars
($6.00) for a period.of not to exceed thirty (30)
days. The location and size of the same shall not
obstruct the view of neighboring property. The per-
mit may contain reasonable conditions including a
deposit of twenty-five dollars ($25.00) to guarantee
the removal of the said banners or pennants at the
end of the permit period.
(b) Pennants (flag pole type only, not,streamers
or pennants on strings or wires) with brand logo or
name of new car dealers shall be no larger than three
(3) feet by four (4) feet.
• (c) 'Use of tethered balloons shall be subject to
approval of the Planning Director as to the design,
size, color, the height that the balloon'.is to be
flown and .any other considerations that the Planninq
Director deems necessary.

(d) Any applicant for any such permit, by the
acceptance or use thereof, agrees to protect the
City and hold the City, its officers and employees,
free and harmless from any and all liability,
claims and damages arising out of or alleged`to .
arise out of the issuance or use of such permit.
(e) No sign permit is required.
SECTION 3: Section 26-304 of the blest Covina Municipal Code is
hereby amended to read as follows:
Section 26-304. Motion.
No sign visible from a public parking area or
street shall be constructed or maintained to
flash, rotate, or in any way simulate motion,
except that barber poles shall be permitted to
rotate at a speed not to exceed eight (8) rev-
olutions per minute, and tethered balloons shall
be permitted as provided in Section 26-339.
SECTION 4: Section 26-307 of the West Covina Municipal Code is
hereby amended to read as follows:
Section 26-307. Illumination.
• (a) All sign illumination shall be from the
interior of the.sign,.except that indirect
lighting shall be permitted, provided the light
source (including fixtures), is not visible
from the street, public.parkinq or public thor-
oughfare.
(b), Exposed neon tubing shall not be permitted
on outdoor signs, except that such signs
erected prior to September 27, 1967, shall be
deemed legal nonconforming signs. Only normal
sign maintenance shall be permitted and copy
changes or sign reconstruction shall not -be
permitted.
(c) Temporary lighting for.tethered balloons
as provided in Section 26-339 is exempt from
the.conditions set forth in paragraph (a) of
this section.
SECTION 5: The City Council finds and determines that said amend-
ment to the Municipal Code is a minor modification to the City's Zoning Ordin-
ance and is, therefore, categorically exempt (Class 5) from the requirements
of the California Environmental Quality Act of 1970 (CEQA).

SECTION 6: The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published as required by law.
