Ordinance - 1501d ORDINANCE NO. 1501 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING CERTAIN SECTIONS OF CHAPTER 19, ARTICLE V OF THE WEST COVINA MUNICIPAL CODE RELATING TO PARADES. • The City Council of the City of West Covina does hereby ordain as follows: SECTION 1. Section 19-118 of the West Covina Municipal Code relating to definitions is hereby amended to read as follows: Section 19-118. DEFINITIONS. As used in this article, the following terms shall have the indicated meanings: Parade is any parade, march,ceremony, show, exhibition, pageant, caravan, motorcade, walk-a-thon, jog-a-thon, run, etc. or proces- sion of any kind, or any similar display, in or upon any street, park or other public place in the city. Parade Permit is a permit as required by Division 2 of this Article. SECTION 2. Section 19-133 (a) of the West Covina Municipal Code relating to applications is hereby amended to read as follows: Section 19-133. .APPL[CATI.ON. (a) Generally. A person seeking issuance of a parade permit • shall file an application with the license collector on forms provided by such officer. SECTION 3. Section 19-133 (b) of the West Covina Municipal Code relating to filing periods is hereby amended to read as follows: (b) Filing period. An application for a parade permit shall be filed with the license collector not less than twenty (20) days nor more than four (4) months before the date on which it is pro- posed to conduct the parade. . SECTION 4. Section 19-133 (c) (12) of the West Covina Municipal Code relating to authorization of applicants is hereby amended to read as follows: (c) (12) If the parade is designed to be held by and on behalf of or for, any person other than the applicant, the applicant for such permit shall file with the license collector a communica- tion in writing from the person proposing to hold the parade, authorizing the applicant to apply for'the permit on his behalf. SECTION 5 Section 19-133 (d) of the West Covina Municipal Code relating to late applications is hereby amended to read as follows: (d) Late applications. The city council, where good cause is shown therefor, shall have the authority to consider any applica- tion hereunder which is filed less than twenty (20) days before the date such parade is proposed to be conducted. SECTION 6. Section 19-133 (e) of the West Covina Municipal Code relating to application fees is hereby amended to read as follows: (e) Estimated expenses. Any costs incurred by the City directly associated with the conduction of a parade shall be paid by the applicant. This amount, if any, shall be determined by the license collector prior to the filing of an application. The estimated expenses shall be accepted as a deposit by the license collector when. the application is- fi led.. SECTION 7. Section 19-133 (f) relating to insurance is hereby added to the West Covina Municipal Code and reads as follows: (f) Certificate of Insurance. A certificate of insurance must be presented with an endorsement indicating the City of West • Covina is additionally insured in the amount specified by the risk manager. SECTION 8. Section 19-135 (a) of the West Covina Municipal Code relating to approval or rejection is hereby amended to read as follows: (a) The City Council shall approve or disapprove the application for a parade permit according to the standards set out in section 19-134 of this article. SECTION 9. Section 19-135 (b) of the West Covina Municipal Code relating to notification to applicant is hereby amended to read as follows: (b) '.The license collector shall mail to the applicant without delay, a notice of the action of the City Council. If the applica- tion is rejected, the notice must state the reasons for the rejection. If the application is approved, the Parade Permit will suffice as notification of approval. SECTION 10. Section 19-135 (c) of the West Covina Municipal Code relating to waiver of insurance requirements is hereby amended to read as follows: (c) The applicant may request in writing that insurance require- ments be waived. The City Council may authorize the waiver if it finds that the size of the parade, its purpose and the manner in • which it is to be conducted is not reasonably likely to cause bodily injury and/or property danage by provoking disorderly conduct or creating a disturbance. SECTION 11. Section 19-136 of the West Covina Municipal Code relating to alternative permits is hereby amended to read as follows: L" Sec. 19-136. Alternative permit. The city council, in denying an application for a parade permit, shall be empowered to authorize the conduct of the parade on a date, at a time, or over a route different from that named by the applicant. An applicant desiring to accept an alternate permit shall, within five (5) days after notice of the action of the city council, file a written notice of acceptance with the license col- lector. An alternate parade permit shall conform to the require- ments of, and shall have the effect of a parade permit under this article. SECTION 12. Section 19-137 of the West Covina Municipal Code relating to notices to city officials is hereby deleted.
