ORDINANCE NO. 1499
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, AMENDING
THE WEST COVINA MUNICIPAL CODE -BY AMENDING
CHAPTER 26, ARTICLE XI,.SECTION 26-602 AND
• 26-604 RELATING TO TEMPORARY USE PERMITS
AND CHRISTMAS TREE SALES.

The City Council of the City of West Covina does
ordain as follows:
SECTION 1: Section 26-602 of the West Covina
Municipal Code is hereby amended to read .as follows:
Section 26-602. Temporary uses -- Tempo-
rary use permit required.
No use mentioned in this section shall be
permitted, commenced or engaged in, how-
ever, until a written permit therefor has
been obtained from the temporary use permit
committee consisting of the license& -;.collector
as chairman, building and safety director,
planning director, risk manager, chief of
police and fire chief, or their respective
deputies or assistants when so authorized,
and four (4) of whom shall constitute a
quorum, and any decision shall be in writing
and shall require the vote or concurrence
. of *at least four ( 4 ) members - or: four " .(4 )- .
alternates and may be subject to specified
conditions. The committee may establish
rules for its own procedures. Any appli-
cant may appear before said committee in
connection with his application, and appeal
the action or decision of the said committee
to the city council within fifteen (15) days
after such action or decision in which case
the city council shall have the power of
denying or granting such permit and setting
forth any applicable conditions relating
thereto. Any such permit.shall be void
unless such conditions are complied with.
Such permits shall be granted only after
written application therefor has been filed
with the city clerk at least fifteen (15)
days before the date of commencement of the
proposed use, and the committee or council
has found that such proposed use, under the
conditions imposed, will not have a substan-
tial adverse effect upon the use or enjoyment
of property in the neighborhood of the pro-
posed use or upon the public safety, health,
or general welfare. 'No formal public hear-
ings need be conducted nor any notice given
except to the applicant in connection with
the granting or denial of such a permit.
SECTION 2: Section 26-604 of the West Covina Municipal
Code is hereby amended to read as follows.
Section 26-604. Same'-- Christmas tree sales.
a) The indoor or outdoor sale limited to
Christmas trees, and stands may be per-
mitted in any zone (residentially zoned
property must be vacant and located so as
not to be detrimental to existing residen-
tial developments) for a period not to
exceed twenty-one (21) days in any calendar
year.
b) Indoor sale. of items stated in Paragraph (a)
accessory to a permanent use shall not re-
quire a temporary use permit.
c) One .single -faced or multi -faced sign not
to exceed 32 square feet per face, con-
sisting of not more than 3 faces will be
allowed on site. A sign permit is not
required. . .
SECTION 3: The Cite Council finds and determines that
said amendment to the Prunicipal Code is a minor modification to
the City's Zoning Ordinance and is, therefore, categorically ex-
empt (Class 5) from the requirements of the California Environ-
mental Quality Act of 1970 (CEQA).
SECTION 4: The City Clerk shall certify to the passage
of this ordinance and .shall cause the same to be published as re-
quired by law.
