Ordinance - 1491• ORDINANCE NO. 1491 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,.CALIFORNIA, ADDING ARTICLE XII TO CHAPTER 7 OF THE WEST COVINA MUNICIPAL CODE CONCERNING REIMBURSEMENT OF THE COSTS OF PUBLIC RIGHT-OF-WAY IMPROVEMENTS IN CONJUNCTION WITH BUILDING CONSTRUCTION. WHEREAS, the City from time -to -time constructs public right-of-way improvements adjacent to property not owned by the City; and WHEREAS, said improvements are a direct benefit to the owner of the adjacent property and an indirect benefit to the City; and WHEREAS; if the City had not constructed said improvements, the owner of the adjacent property would be required to construct said improvement in conjunction with building construction; NOW, THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: 1. The attached Exhibit 1 is hereby adopted as Article XII of Chapter 7 of the West Covina Municipal Code. 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. PASSED AND APPROVED this 8th day of September , 1980. REIMBURSEMENT OF THE COSTS OF PUBLIC RIGHT-OF-WAY IMPROVEMENTS IN CONJUNCTION WITH BUILDING CONSTRUCTION Sec. 7-200. Application of Article. .The provisions of this article shall be applied in instances when all of the following .conditions are met: 1. At the time of.construction of the public right -of -way -improve - improvements a reimbursement agreement was established. 2. The construction of the public right-of-way improvements would be required by Section 7-185 of this Code if they had not already been constructed. 3. Any payment for right-of-way dedication and any cost for por- tions of the street between the curb and centerline over eight (8) feet in width are not included in the reimbursement agreement. Sec. 7-201.' Reimbursement Agreement. In those instances where the City Engineer deems it advisable to . establish a reimbursement agreement for public right-of-way improve- ments, the City Engineer shall present to the City Council for con- currence the proposed agreement and the estimated cost for each pro- posed reimbursee. The presentation shall be made prior to any improvements being constructed. After construction is completed and all costs are verified, the City Engineer shall present the Reimbursement Agreement with the final costs for each reimburser to the City Council for approval of the agreement. At that time the City Council may approve asppresented, approve as it modifies, or disapprove the Reimbursement Agreement. Sec. 7-202. Collection of Reimbursement. Any person, owner, lessee, or agent who would have been required to construct or install street improvements under provisions of Section 7-185 of this Code if they had not already been constructed by the City and for which a Reimbursement Agreement has been established, shall pay the designated amount of reimbursement to the City prior to the issuance of a building permit or other form of construction approval by the City. f C le, R '1' I F I C A T I O N k State of California. ) County of Los Angeles ) ss.
