AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, AMENDING
THE WEST COVINA MUNICIPAL CODE BY AMENDING
• SECTION 10504.08 TO PART V, CHAPTER 1,
ARTICLE X RELATING TO TIME EXTENSION OF
THE EXPIRATION DATE FOR VARIANCES
.(Amendment No. 158)
The City Council of the City of West Covina, California,
does ordain as follows:
SECTION 1: Section 10504.08 of the West Covina Municipal
Code is hereby amended to read as follows:
"10504.08 FAILURE TO UTILIZE VARIANCE OR SLIGHT
MODIFICATION
a) Variances approved in conjunction with cases
which are dependent on the variance, (precise
plans, parcel or tract maps, unclassified use
permits, etc.) shall expire on the same ex-
piration date as the case.
Approval of a time extension for such cases,
shall constitute the approval of a time ex-
tension of the variance on which the case is
dependent.
• b) A variance or slight modification not in con-
junction with other cases shall become null
and void if not utilized within one (1) year
from date of the resolution granting the
variance or slight modification. If construc-
tion work is involved, such work must be
actually commenced within the stated period
and be diligently pursued.
Extension of time up to a maximum of one (1)
year may be granted from the date of expiration
of the variance or slight modification by the
Planning Commission or City Council when exten-
uating circumstances can be clearly shown by
the applicant. The request for the extension
shall be submitted to the Planning Commission
in writing prior to the expiration date, and
shall clearly state the reasons why such vari-
ance or slight modification has not been utilized."
SECTION 2: The City Council finds and determines that said
amendment to the Municipal Code is a minor modification to the City's
Zoning Ordinance and is, therefore, categorically exempt (Class 5)
from the requirements of the California Environmental Quality Act of
1970 (CEQA).
. SECTION 3: The City Clerk shall certify to the passage
of this ordinance and shall cause the same to be published as re-
quired: by law.
