Ordinance - 1463ORDINANCE NO. 1463 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING ARTICLE III, DIVISION 4 OF THE WEST COVINA MUNICIPAL CODE, RELATING TO THE COMPOSITION, TERMS, DUTIES AND . POWERS OF THE PLANNING COMMISSION. The City Council of the City of West Covina does ordain as follows: SECTION 1. Article 111, Division 4 of the West Covina Municipal Code is amended to read: Section 2-106. Created; composition A Planning Commission is hereby created. The Planning Commission shall consist of five members, residents of the City of West Covina, appointed by the City Council. . Section 2-107 Terms of office and removal The members of the Planning Commission shall be appointed by resolution of the City Council for staggered four-year terms ending on June 30. Each member shall hold office after the expiration of his term until his successor is appointed and qualified. All members shall serve at the pleasure of the City Council. By resolution, the City Council may remove a member of the com- mission from office at any time during the term for which he was appointed. Section 2-108 Vacancies Vacancies in the Planning Commission occurring otherwise than by expiration of •the term shall be filled for the unexpired term of the commissioner leaving the Planning Commission, in the manner set forth in this division. Section 2-109 Council Liaison The Mayor, with the consent of the City Council, shall designate one member of the City Council to serve as liaison between the City Council and the Planning Commission. The member of the City Council designated as liaison to the commission may participate in the deliberations of the commission but shall not be a member of the commission, nor be entitled to vote on -any matter coming before the commission. The liaison will provide assistance in the communication linkage between the Council,�arid the Commission; and will assist the Commission in understanding councilmanic policies. Section 2-110 Organization The Planning Commission, at its first regular meeting each July, shall elect a chair- person and a vice chairperson from among its members, both of whom shall serve one year -terms. The commission may also elect a secretary for the commission; and the person elected secretary does not need to be a member of the commission. The commission shall have the power to adopt rules for the transaction of business and shall keep a record of resolutions, findings and determinations. Section 2-111 Meetings •The Planning Commission shall hold regular meetings at least once a month, and shall determine, by resolution, the manner in which such meetings shall be organized and conducted; and the day(s) of the month on which the meetings will be held. The time and place of said meetings shall be as provided for by resolution adopted by the City Council. A majority of the members of the com- mission shall constitute a quorum for the transaction of business. All meetings, including special meetings, shall be held in the manner provided for in the Ralph M. Brown Act, sections 54950 through 54961 of the California Government Code. Section 2-112 Compensdfi.on Each member of the Planning Commission'shalI be paid for services as such member a monthly compensation of fifty dollars for each month, ;©r part thereof, served. Section 2-113 Duties and powers . It shall be the duty of the commission created by this division to: (a) To prepare, adopt, and recommend to the Council a comprehensive long-term plan for the physical development of the City, which shall be known as the City of West Covina General Plan. (2) To prepare, adopt and recommend*to the Council plans based on the general plan and drafts of such regulations, programs, and legislation as may, in its judgement, be required for the systematic execution of the general plan. (c) To act as the advisory agency of the Council in connection with the admin- istration of the State Map Act. (d) To hear and decide applications for variances, unclassified use permits, tentative tract and parcel maps, as well as precise plans of design in accordance with adopted rules and procedures. (e) To investigate, hear, and recommend to the City Council plans for the im- provement and beautification of the City, including such matters supplementation or change of zoning regulations and districts. (f) To perform all other duties as may be imposed by law or the City Council. . Sections 2-114 - 2-115 Reserved SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
