AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING ARTICLE III,
DIVISION 3 OF THE WEST COVINA MUNICIPAL CODE,
RELATING TO THE COMPOSITION, TERMS, DUTIES AND
POWERS OF THE PERSONNEL COMMISSION.
• The City Council of the City of West Covina does ordain asrfollow's:
SECTION 1. Article III, Division 3 of the West Covina Municipal Code is
amended to read:
Section 2-91 Created; composition
A Personnel Commission for the City is hereby created. The Personnel Commission
shall consist of five members, residents of the City of West Covina, appointed by the City
Council.
Section 2-92 Terms of office and removal
The members of the Personnel Commission shall be appointed by resolution of the City
Council, for staggered four-year terms ending on June 30. Each member shall hold office after the
expiration of his term until his successor is appointed and qualified. All members shall serve at the
pleasure of the City Council. By resolution, the City Council may remove a member of the Com-
mission from office at any time during the term for which he was appointed.
Section 2-93 Vacancies
Vacancies in the Personnel Commission occurring otherwise than by expiration of the term
• shall be filled for the unexpired term of the Commissioner leaving the Personnel Commission, in the
manner set forth in this division.
Section 2-94 Council Liaison
The Mayor, with the consent of the City Council, shall designate one member of the
City Council to serve as liaison between the City Council and the Personnel Commission. The mem-
ber of the City Council designated as liaison to the Commission may participate in the deliberations
of the Commission, but shall not be a member of the Commission nor be entitled to vote on any
matter coming before the Commission. The liaison will provide assistance in the communication
linkage between the Council and the Commission; and will assist the Commission in understanding
councilmanic policies.
Section 2-95 Organization
The Personnel Commission, at its first regular meeting each July, shall elect a chair-
person and a vice chairperson from among its members, both of whom shall serve one-year terms.
The Commission may also elect a secretary for the Commission; and the person elected secretary
does not need to be a member of the Commission. The Commission shall have the power to adopt
rules for the transaction of business, and shall keep a record of resolutions, findings and determinations.
• Section 2-96 Meetings
The Personnel Commission shall hold regular meetings at least once a month; and shall
determine, by resolution,the manner in which such meetingsshall be organized and conducted; and
the day(s) on which the meetings will be held. The time and place of said meetings shall be as
provided for by resolution adopted by the City Council. A majority of the members of the Com-
mission shall constitute a quorum for the transaction of business. All meetings, including special
meetings, shall be held in the manner provided for in the Ralph M. Brown Act, sections 54950
through 54961 of the California Government Code.
Section 2-97 Compensation
Each member of the Personnel Commission shall be paid for his services as such
member a monthly compensation of twenty dollars for each month, or part thereof, served.
Section 2-98 Duties and Powers
0 It shall be the duty of the commission created by this division to:
(a) Advisory Capacity. As provided in division 3 of Article III of this chapter and
the rules, to act in an advisory capacity to the Council and the Personnel Officer on personnel matters
not specifically delegated by law to other parties in the City service.
(b) Review Personnel Administration. To continually review the recruitment and
selection process for the classified service, including the publishing or posting of test notices and
the preparation and scoring of tests, and the certification of eligibles for appointment, and to
review the City's position classification system, and to make comments and recommendations re-
garding such processes to the Personnel Officer of the Council.
(c) Request for Hearings. When requested by the Council or the Personnel Officer,
the Personnel Commission shall hold hearings and make other recommendations, on any of the matters
of personnel administration, within the limits of the request by the Council or the City Manager.
(Code 1960, Section 2409)
(d) Appeals. As provided by division 3 of Article III of this chapter and by the
Personnel Rules, to receive and hear appeals submitted by any person in the City service relative to
any dismissal, demotion, reduction in pay, or alleged violation of such division 3 or the classification
and salary resolution of the Personnel Rules; and to certify its findings and recommendations as pro-
vided in this chapter.
(e) Hearing Procedures, Subpoenas. In any investigation or hearing conducted by
. the Commission, it shall have the power to examine witnesses under oath and compel their attendance
or the production of evidence before it by subpoenas, issued in the name of the City and attested by
the City Clerk. It shall be the duty of the Chief of Police to cause all such subpoenas to be served
and refusal of a person to attend or testify in answer to such subpoena shall subject such person to
prosecution, in the same manner set forth by law for failure to appear before the City Council in
response to a subpoena issued by the City Council. Each member of the Personnel Commission
shall have the power to administer oaths to witnesses.
Sections 2-99 - 2-105 Reserved
SECTION 2. The City Clerk shall certify to the passage of this ordinance and
shall cause same to be published as required by law.
