AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, AMENDING
Y_ THE WEST COVINA MUNICIPAL CODE BY ADDING
SECTION 10802.01.01 AND AMENDING SECTIONS
10804.01, 10804.02 AND 10804.04 OF PART
VIII, CHAPTER I OF ARTICLE X, RELATING TO
STOCK COOPERATIVES AND COMMUNITY APARTMENTS
IN THE MULTIPLE FAMILY ZONES. (Amendment
No. 155)
The City Council of the City of West Covina does
ordain as follows:
SECTION 1. The West Covina Municipal Code is
hereby amended by the addition thereto of a new Section
10802.01.01 to Article X, Chapter I, Part VIII thereof to
read as follows:
"10802.01.01
For the purpose of this Chapter, stock coopera-
tives and community apartments shall be treated
as condominiums."
SECTION 2. Section 10804.01 of the West Covina
Municipal Code is hereby amended to read as follows:
"10804.01 CONDOMINIUM
• a) Condominium
An estate in real property consist-
ing of an undivided interest in
common in a portion of a parcel of
real property, together with a separ-
ate interesti'h�..a space in a residential
building on such property.
b) Stock Cooperative
A "stock cooperative" is a corporation
which is formed or availed of primarily
for the purpose of holding title to,
either in fee simple or for a term of
years, improved real property, if all
or substantially all of the share-
holders of such corporation receive
a right of exclusive occupancy in a
portion ofthe real property, title to
which is held by the corporation, which
right of occupancy is transferable only
concurrently with the transfer of the
share or shares of stock in the corpor-
ation held by the person having such
right of occupancy.
c) Community Apartment
An,apartment in which an undivided
interest in the land is coupled with
the right of exclusive occupancy of
any apartment located thereon."
SECTION 3. Section 10804.02 of the West Covina
Municipal Code is hereby amended to read as follows:
"10804.02 CONDOMINIUM PROJECT
a) The entire parcel of real property
divided, or to be divided, into
condominiums including all structures
thereon.
b) The entire parcel of real property
converted or to be converted into
condominiums, as defined in Section
10864.01, including all structures
thereon."
SECTION 4. Section 10804.04 of the West Covina
Municipal Code is hereby amended to read as follows:
"10804.04_ UNIT, CONDOMINIUM
a) The element of a condominium project
which is not owned in common with the
owners of other condominiums in the
project.
b) Dwelling unit of a condominium project
defined in Section 10804.01(b) and
10804.01(c)."
SECTION 5. The City Council finds and determines that
• the revisions,of the zoning provisions of the West Covina Munici-
pal Code as contained in this ordinance is a minor alteration in
the land use regulations and as such is categorically exempt under
the California Environmental Quality,Act of 1979 and the State
Guidelines.
SECTION 6. The City Clerk shall certify to the passage
of this ordinance.and shall cause the same to be published as re-
quired by law.
