L ORDINANCE NO. 1452
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA MAKING THE POSITIONS OF CITY
CLERK AND CITY TREASURER PART OF THE MERIT
SYSTEM PERSONNEL PROGRAM OF THE CITY AND
AMENDING SECTION 2206 OF CHAPTER 2, ARTICLE
II OF THE WEST COVINA MUNICIPAL CODE.
WHEREAS, the City Council on this date has adopted
Resolution No.5982 , ordering, calling, and providing for a
special municipal election to be held in the City on November 6,
1979, for the purpose of submitting to the qualified voters of
the City certain proposals relating to:whe ther the offices of
City Clerk and City Treasurer should be appointive, rather than
their present status of elective offices.
WHEREAS, pursuant to the provisions of Section 2206
of Chapter 2, Article II of the West Covina Municipal Code, the
power and authority to appoint and remove personnel and to
otherwise administer the Merit System Personnel Program of the
City have been delegated to the City Manager of the'City of
West Covina, and that further, the City Manager is vested with
authority pursuant to Section 2206(e) to appoint, and when
necessary for the good of the services, to discipline or remove
all officers and employees of the City, except certain 'enumerated
officers and employees including the City Clerk and City
Treasurer; and
WHEREAS, it is the intent of the City Council, in the
event the electors of the City choose to make the offices of
• City Clerk and City Treasurer appointive, to have both of those
positions to be treated in the same manner as any other position
included in the existing Merit Personnel System of the City; and
WHEREAS, it is the intent of the City Council, in the
• event that the above -mentioned ballot measures are approved by
the voters of the City, to include the positions of City Clerk
and City Treasurer within the present Merit System Personnel
Program of the City, which positions shall be subject to the
authority delegated to.the City Manager in connection with the
administration of the Personnel System.
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. Section 2206(e) of Chapter 2, Article II,
of the West Covina Municipal Code relating to the delegation of
the administration of the personnel process is hereby amended to
read as follows:
"(e) Subject to the limitations set forth
in Article II, Chapter 4, there shall be vested
with the City Manager authority to appoint and
when necessary for the good of the services to
discipline or remove all officers and employees
of the City except:
(1) Members of Boards and Commissions
appointed by the City Council
(2) The City Attorney
Provided, however, that the City Manager may
authorize the head of a department or office to
• appoint and remove subordinates subject to the
provisions of applicable ordinances and resolu-

SECTION 2. Notwithstanding the adoption of this
ordinance, the provisions contained herein shall only become
effective when and if the above -mentioned ballot measures are
approved by the voters of the City. In the event the offices
of City Clerk and City Treasurer do not become appointive
offices as a result of said election, this ordinance shall be
of no further force and effect.
SECTION 3. The City Clerk shall certify to the
adoption of this ordinance and shall cause the same to be
published as required by law.
