AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA REMOVING CERTAIN PORTIONS OF
LAND FROM THE EXISTING INTERIM BUILDING
MORATORIUM IMPOSED ON THE CENTRAL BUSINESS
DISTRICT SURVEY AREA NO. 1 AS AMENDED, SAID
ORDINANCE TO BE ADOPTED AS AN URGENCY
ORDINANCE.
WHEREAS, the City Council on May 14, 1979, by Resolution
No. 5919 directed the West Covina Planning Commission to select
an amended Redevelopment Project area comprised of all or part
of Redevelopment Survey Area No. 1, as further amended and
redesignated as shown on the map attached to said Resolution as
Exhibit "A", said,map incorporated herein by this reference; and
WHEREAS, the City Council on May 29, 1979 adopted an
urgency zoning moratorium ordinance (Ordinance No. 1439 )
prohibiting the issuance of any building permit to any person for
the commencement or establishment of any use or development of
any project located within the Central Business District
Redevelopment Survey Area No. 1, as amended and set forth as
Exhibit "A" attached hereto, pending a study and determination
by the Redevelopment Agency and its staff, the City's Planning,
Engineering and Public Service Department's staff of the
selection of an amended Redevelopment Project Area and whether
there exists or will exist any conflicts between existing or
proposed land uses and those designated land uses as set forth
in the Amended Redevelopment Plan; and
WHEREAS, the above -mentioned urgency ordinance was
adopted in order to identify and prevent any conflicts between
• currently proposed development plans, said plans being at
various stages of the City's precise plan process, and the final
formulation and adoption of a plan for the redevelopment of an
amended project area; and
WHEREAS, the City Council in adopting said urgency
moratorium ordinance specifically directed staff to complete the
necessary studies as soon as possible in order to insure the
minimum disruption to any planned development within the area
covered by the moratorium, and further the Council committed
to making the necessary determinations regarding the building
moratorium as soon as the necessary studies and recommendations
were complete; and
WHEREAS, the Redevelopment Agency has been conducting
and reviewing the results.of building condition surveys and
environmental condition surveys, circulation patterns, utilities,
zoning and existing land uses within said survey area, and
further with City staff there has been an exploration of
solutions and alternatives to circulation, land use and zoning
problems within said survey area; and
WHEREAS, pursuant to said studies described above, it
has been determined that there exists four different and distinct
areas referred as to Areas No. 1, 2, 3 and 4 on Exhibit "A", and
that further said areas are completely isolated from each other
physically, and further that the land use patterns for each of
said areas are different and have no relationship to each other
in that: Area No. 1 fronts on the San Bernardino Freeway, so
that existing businesses are dependent on freeway orientation,
which impacts the existing land uses; Area No. 2 is situated
along a major arterial and is characterized by hospital and

medical office building uses; Area No. 3 is characterized by
various land uses devoted to strip commerical uses with an
interspersion of residential and office uses; and Area No. 4
is situated along a major arterial and its uses are primarily
devoted to strip commercial, specifically, auto dealerships
• and auto -related uses; and further as a result of the above -
described conditions, the blighting influences and problems
are germane to each area independently and, therefore, cannot
be characterized as a whole; and
WHEREAS, the studies described above have been
completed as to Areas Nos. 1, 2 and 3 as set forth on Exhibit "A"
attached hereto, which studies have determined that no conflict
exists between present or proposed land uses and the formulation
of the proposed Redevelopment Plan; and
WHEREAS, said studies and investigations described
above with respect to Area No. 4 have not at this time been
completed with respect to any recommendation regarding the
building mor torium on said Area No. 4; and
WHEREAS, the findings and conclusions set forth in
said staff report dated August 13, 1979 from the Redevelopment
Agency to the City Council and City Manager are hereby incorpor---
ated by reference herein;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST
COVINA DOES ORDAIN AS FOLLOWS:
SECTION 1. Pursuant to the findings and conclusions
set forth above, those certain portions of land described as
• Areas 1, 2 and 3 on Exhibit "A" are hereby removed from, and
no longer subject to, the provisions of the existing urgency
building moratorium imposed on the Central Business Survey
Area No. 1 by Urgency Ordinance No. 1439, previously adopted
by this Council on May 29, 1979. In all other respects, the
provisions of the previously adopted urgency interim zoning
ordinance shall remain in full force and effect.
SECTION 2. This ordinance is hereby declared an
urgency measure and shall take effect immediately upon its
adoption by a four -fifth's vote of the City Council. A state-
ment of facts constituting the basis for the urgency of this
ordinance is as follows:
There exists at the present time in those

interim zoning ordinance a number of proposed
development projects which have been prevented
from securing the necessary building permits to
begin construction as a result of the imposition.

In addition. it has been determined that a certain
number of proposed development projects which
have been approved by the City may have their
committed construction loans cancelled and, therefore
without the immediate adoption of this ordinance,
• there will be increasing costs in an unknown amount
to said development projects, which may render the
project economically unfeasible. Said projects have
been determined not to be in conflict with the
proposed redevelopment plan, but rather consistent
with the goals and policies of community redevelopment
within the City. This ordinance is therefore
necessary for the immediate preservation of the
public peace, health and safety.

SECTION 3. The City Clerk shall certify to the
adoption of this ordinance by a four -fifth's vote of the
Council and shall cause the same to be published in the
manner prescribed by.law.
